Former employer filed for bankruptcy, what are my chances of seeing the money I was never paid?

I worked for a landscaping business back in April, and was never paid a cent of what I was owed. Me, and the rest of my co-workers he abused(quite literally, vocally and otherwise) filed a complaint against him, and the Labor Board found him in flagrant violation of a number of laws. He owed a large chunk of change, to the tune of double what we were owed being compounded to the original sum in punitive damages. Some of us were owed 00 and better. I am assuming I will be paid, as I did do work for him that went unpaid, and he still has equipment and land to liquidate, but my faith in humanity and the legal system border on non-existent. My question is this- Will I indeed be paid in full, or are there any legal loopholes he can weasel his way in to? He has a long history of doing this, and will continue to do this if he isn’t stopped. I am probably closer to the bottom in priority, as I’m only owed in the hundreds of dollars, not the considerably more astronomical amounts one accrues working 20 hours for 7 days a week for this guy. The longer this drags on, the more I think he has a plan, and that my initial opinions of his intelligence were all wrong. I need that money to fulfill personal ambitions, so any help would be greatly appreciated.

I know the basics of bankruptcy, but I have a specific situation and I was just wondering what differences there might be with it…If anyone could help explain this I’d be very grateful.

So, my dad owned a small chain of local banks. After the economy crashed, it struggled…given more time and–well I won’t get into details–basically, the FDIC claimed it wasn’t strong enough/had too many bad loans/wasn’t going to make it. So then they took over.

Long story short, my dad was owner, CEO, and president. So everything that went wrong fell on his shoulders (even though it wasn’t his fault)….now, after investigating the loans and business that my dad’s banks were making, the FDIC is suing my dad for 35,000,000 dollars.
We don’t have that kind of money.
My parents will have to file for bankruptcy; but will it be different because it’s the government that’s suing him? Will there be more to it? More "strings attached" so to speak? I’m not really sure what questions to ask — if anyone could just shed some light on the situation….I’d appreciate it.

I owe a man who filed bankruptcy chapter 7 in Ohio and I recieved a letter saying to pay the lawyer not him. It says in the letter and I quote "The undersigned is the duly appointed and qualified Trustee in the above captioned proveeding under Chapter 7 of the Bankruptcy Code. As trustee I have legal title to all non-exempt assets of the Debotors in this case invluding any of their right to the balance uner a vertain installment sale of may 10th 2010, where you purchaed back from Mr. **** his interest in my company name. Then it says to send all payments to the lawyer.

My question in why am I sending him the money? Who is actually getting the money and what if I am looking to file bankruptcy? I am not looking to lose my business but now I am curious.

If you need more info just let me know I’m trying to be as specific as I can.

Plz help is this normal for…?

try the BP CLAIMS FUND – heard they have good track record of paying out NOT!
if its hard for you to get a loan, think how hard it has been for us down south who have not gotten any support from the so called "claims fund"

who isn’t making any type of return on his Gulf Coast Claims Center.
he doesn’t want to help out the poor, gulf coast business owners and men, and women who are still unemployed there.

My daughters husband is a dreamer: goes from one job to another. He finally drove them into financial ruin by trying to operate a house gutter business. My husband & I have been buying groceries & paying some bills for them over the last year. They lost their health insurance & have 2 sons, one with diabetes & one with asthma. My son-in-law has ticked a lot of people off by not showing up for jobs & is being sued. He is not a nice person but seems to think the world owes him a living. We help our daughter & grandsons because it’s not their fault but have got to the stage where we think we’re enabling him by giving them money. It’s gotten as far as having to co-sign for our daughters car so she can get to work.
The S-I-L has now got a restaurant job but they are still in debt & talking about bankruptcy (again).
We have an unexpected bill ourselves this month & would like to get some money back (the 0 we lent him to buy a truck when his got re-possessed would be nice).

Legal HELP-Car repossession process – now what happens?

My closest friend just phoned me to pick him up because his car has been repossessed. I’ve tried to help with organizing his finances by consolidating but he didn’t listen. Now his 1 car has been repossessed. He has 3 other cars, one he’s behind by many payments & is upside down & owes more than it’s worth. He had total 4 cars, 2 he owns – 1 isn’t worth much (old) & the other IS worth a LOT. The other 2, one is now repossessed & the other will likely also be repossessed. He’s upside down on both & has not made payments on either in several months & isn’t likely to come up with the money to get caught up. Even if he did get caught up, he would need minimum of k on EACH of the 2 cars to be even with the value of them. (He can’t sell them unless he comes up with k per car)

He asked if he should voluntarily have this one repossessed also. He’s considering filing BK now. He’s asking me about what’s going to happen. I told him it’s possible they will win a judgment against him & may have the right to cease assets to pay his debt for the money he will owe after they sell his car at auction (the difference of costs from the loss to them).
Can they cease his other assets? (I told him to sell the valuable car asap to keep them from ceasing it – just in case)
I also told him to consider a bankruptcy filing.

Please tell me, does anyone know what rights they will have now?
Is filing for BK the best way out of this mess to start new & fresh & remove old habits? Or is there another way? He knows this would remain on his credit for 10-years if he files. He isn’t likely to have the money to get the payments caught up, also since he’s so upside down, why be prisoner to all of this if there’s a legal way to start new?

Someone with legal knowledge, please help me with this, I’d like to advise him with facts that will really help him. He’s a mess & very stressed from late notices, phone calls & now they are taking away from him these things. How much worse could it get? What is the wisest solution?

P.S. – He also owns a small business (suffering)

We filed Chapter 7 in Sept 2009 it was final Dec 7 2009. Now our son and his family were trying to buy a house and found bills on his report on me with my husbands Social Security Number on them. He called me yesterday all Huffy. Asked how our bills showed up on his Social Security Number like I had any way of explaining this to him. I told him I did not know How they could be on his credit report.When he and his father have different Social Security Numbers.Big difference between 332 and 432 one born in 1958 one born in 1982 My husband is Paul Lee and our son is named after his father he is Paul Lee II. He gave me the number I called the business and they got nasty with me. It ended up being a screaming match before it was all over. I told them that we had filed bankruptcy and anything with MINE or My Husbands Social on then went in Bankruptcy. They told me HELL NO they did not that these were my bills they were on my husbands Social Security Number with me as patient and they were on my sons credit report since they could not get the money from us Our son would have to pay them Or else they would go to Collection But Someone was sending them the money. I told them they went with our bankruptcy. But she refused to hear what I was saying Everytime I opened my mouth to say anything the woman would cut me off. I called my lawyer who handled our Bankruptcy and he assured me that these went with the bankruptcy. Because we listed this Company Name on our Records as having bills with them and so they pull up any accounts with Mine and Hubby’s Social Security Number on them they do not look at names or any thing they go into their system and pull up the accounts with Number that match ours. And then they are deleted. But can someone tell me who to call to find out why this happened. Nobody can bother to explain to us how to fix this. Only Seious Responses to this please this is Hurting Our sons Credit.
Son is not Junior he is the 2nd. But I think some of the problem is he refuses to use the 2nd after his name. And at different times in their marriage they have lived at our address and or expected me to take their kids to the Doctor or Hospital because they are to Lazy to tend their own business. But my lawyer said it goes on Social Security not name anyway. So I have no explanation for my son
I was on the phone call with my son yesterday they told him to hae me call them about the bills so I did they dialed him back and told me I had to take care of the fowl up. Because they were my bills. The lady was giving out my husbands social securtity number like it was candy. My son told her it was nothis number. She told us both tough crap basically it was there we filed Bankruprcty so pay it. Or it would not be removed.

I hate to ask; other than Small Business Loans Tax credits & Bankruptcy Settlements how do Republicans get $$$?

I see Yahoo is Censoring and Blocking the name of the Minority Leader of the US House of Representitives. Did someone actually Pay Yahoo to do that.

creditor keeps reporting me to collection agency for non-payment even after i filed bankruptcy. Is it allowed?

I had the bad luck of doing business with a very vicious, ruthless, and crooked creditor. He used every single tactic he could to get money out of me, but i kept resisting him. He placed over 67 calls a day using an automated voice. He then bombarded my email with demands to pay. he totally flooded my inbox with like 40,000 mails demanding payment. I told him i have bankruptcy lawyer and he responded using abuses, "no you don’t, you bus turd" My bankruptcy lawyer contacted this creditor asking him to stop placing calls. Then this creditor sued me in court, KNOWING i have a bankruptcy lawyer. I physically had to go to court just to tell i have lawyer. His objective was to stress me out, by making me go to court because he knew it bankruptcy filing will discharge the debt. Then he again sued me in court of appeals, saying, "proof of bankruptcy still not shown". Second time my bankruptcy lawyer contacted court and his suit was thrown out. Then i filed chapter 7 bankruptcy. However, even after filing chapter 7 this vicious creditor keeps reporting to collection agency that i’m seriously delinquent. I checked my credit report and all other creditors whose debt was discharged no more contact the credit bureau. But this creditor alone keeps doing it out of pure vengeance.

We may have to file bankruptcy b/c my hubby’s building business is not doing well these days…if we file personal bankruptcy will they look at and take all assets to pay off debt under chapter 13? My problem is that my parents put their paid for house in my name and my 2 brothers names about 5 years ago because they are in their 70’s…they have also put money in my name although we still give them the interest checks on it. They did this to avoid a potential nursing home someday getting their assets…..anyway, if we file bankruptcy will they go after these assets? If so, what will they do? Can I take these assets out of my name and then file bankruptcy? If so, will they still be able to tell they were recently in my name? Do I need to wait a certain period after removing these assets from my name before filing? We would really like to keep our house and cars but the credit card bills are really hurting us.

I am not sure what kind of BK atty to contact if any. I have a great job, make good money, and I have less than K in personal debt outside of my home. I am having to close down a small business. The problem is I have a personal guarantee on the business loan, lease, and equipment for the business. The equipment has enough equity to take care of itself, but it leaves the loan and lease. I owe roughly K on the loan, and have roughly 0K on the lease left. I don’t have any toys or extras, as my family leads a very modest lifestyle, and ultimately have fallen victims to the bad economy. The business is three years old, and we were on pace to have the business debt free within 5 years. We paid everything in advance, and now looking back was a mistake. All options to extend the debt and restructure have been exhausted. We are now going to be on the hook for almost 0K that we will never have means to pay off. I don’t know where to begin. Do I contact a business atty, a personal atty, or should I be thinking of other options. The loan is with an individual, while the lease is with a major leasing company.

How to rate a BK attorney and find a good one that will work hard for you?

We fell on some devistating hard times due to illness, medical bills, ect ect ect. After our only vehicle got repossessed we sifted through hours and hours of online and phonebook ads for bad credit loans to attempt to borrow some money so we can get vehicle back. Seems either they’re all payday loans of small amounts that aren’t big enough to do any good with insane interests or just total scams. Its been exhausting and very depressing. So now we realize that the only answer is to file for chapter 13.

Just as overwhelming is trying to find a good BK lawyer. How do you sift through all the generic ads to find a good one? We don’t have a lot of time for testimonials as we’ll have 3 business days to find one and get working to save what little we have left.

What kind of loans are available to buy a house for someone with not so good credit?

My husband died early this year. He had, so he said, and insurance policy for ,000.00. He got papers every year from Prudential which he opened and put away. When he died, however, and I called the company, I found out that he had lied, (not the first time), and the only insurance he left was a 2000.00 policy in his parent’s name, he had let the other policy lapse last year.

The house I am living in now was in foreclosure…my late mother in law bought the house back in 1996 and we paid her rent money every month towards the mortgage payments. After she died, my husband took the advice of a friend of his at work who told him, "You don’t have to make any house payments until the probate is settled", which of course was not true. So my husband, while assuring me he was making the house payments from a checking account he had in his own name was in fact not making them, and lying to me about it. (YES, I KNOW he was an idiot, but it gets worse.)

Without telling me a word about it, he allowed the house to go into foreclosure, it was a default case, and he didn’t even OPEN any of the papers he got from the court. The papers all went down to his late mother’s house, since the loan was in her name, and I didn’t see them, or I would have taken steps to stop it. (He also let her house go into foreclosure and lost it at auction last year. Yes, an idiot.)

The first I heard of it was when he told me that the house was due to be sold at sheriff’s auction. Frantically, I looked on line and he declared emergency bankruptcy with less than 24 hours to go before the sale. He then went through Loss and Mitigation. Right now, they want to refinance the loan but the loan is STILL in my late mother in laws name, even though I have sent them 4 copies of her death certificate, and called them 7 times to explain the situation.

I don’t even WANT this house any more because I can’t stand it, it needs major repairs, and our next door neighbor is crazy and keeps gossiping about us all over town and is showing an unnatural interest in my pretty 19 year old daughter.

We saw a house in town that we love and can get for ,000.00. Unfortunately, I don’t have much money at all, since I had to pay off a few creditors after my husband died unexpectedly in February.

Right now I am not working; I lost my job early in 2008 after the company I worked for went out of business. I have been applying for jobs ever since without success, and believe me I’m not picky. I don’t have a very good credit history right now, since my late husband and mother in law took out credit cards in my name after we moved and the applications came to my mother in laws house (where we had lived) and they filed them out, maxed them out, and never paid on them. (My husband told me at first it was my mother in law who took them out herself, telling me this after she died, then late in January he confessed that he had taken them out with her too, (Believe me when I say if there hadn’t been a death there would have been a divorce)). So I don’t know if that’s why I can’t get a job or if it’s my age. (I’m in my mid 50’s and a lot of companies are hiring younger people now.)

My 22 year old son, who is out of school and working, and my 19 year old daughter who goes to school and works part time live with me, and I get a Social Security check for me and my 12 year old daughter every month. We want this house very badly, I can’t sell mine right now because it needs too many repair jobs, which my husband never did, and I don’t have the money to have them done.

We really want the other house. Is there anyplace we can get a loan in our situation? Anyone who can give me some good advice, (and not smart mouth me about my situation, or my horrid late husband and his equally horrid mother), I would so appreciate it. This house is driving me to despair and I so want to start out in a new place, fresh away from any reminders of my late husband and away from the hideous neighbor. (This reads like a bad movie, I know, but it’s all true.) Thank you!

my husband of 1.5 year has been very dishonest with me. A few things happened over the past year and I decided to forgive him and give him another chance. for example when he went to Las Vegas while i was on a business trip and lied about it to me. anyway, today i found out that he filed for chapter 13 bankruptcy about 3 years ago (before we got married) and never told me about it. He also has transferred K worth of debt under my credit cards (i knew about this). I’m totally devastated and thinking about leaving him, I think this is something major to share with your partner before you get married…I’m a professional and make good money and I can’t get over the bankruptcy dishonesty. Anyway idea?

$400,000 household income. Can I file Bankruptcy without My Husband?

I own a condo in my name only where I lived before we got married and it is currently rented but it is always a couple of hundred dollars less than the mortgage and the association dues. I doubt I could sell it in this economy. I came into this marriage with over ,000 in unsecured debt. My only other asset is approximately ,000 in a 401k. My husband pays for the house, our household expenses, my insurances and most everything. The money that passes through our household is approximately 0,000 (my portion being ,000) but our expenses are right up there. He has a business, mortgage, a couple of employees, but with the declining economy and less business being generated, we are basically working to support the debt.

I live in Georgia and if I could file for bankruptcy, without my husband AND without making him in any way liable I would like to do that. Here’s a couple of deal-breakers on the whole bankruptcy thing for me:

* I do not want my work to know — not critical to the job but just embarrassing. No payroll deduction.

* Is a legal notice in the newspaper a must for Chapter 13?

* Would my debt be reduced or canceled altogether.

* I am not behind in my payments — yet —- but it sure is squeaky tight here.

What do you all recommend for someone in my position.

For those that wondered how I got into debt: former marriage where my ex left me with ,000 in debt, other medical bills and having to do it all by myself. Have great credit but I am suffering anymore. You have to walk a mile in someone elses shoes before you judge.

Just started a business and may already be going under…what happens to our home, finances?

So here is the story. we signed a lease for 3 years for a store that already had some inventory and the buildout done. We were upfront and said we had little finance options. so to pay them for the good and buildout we had to pay a certain amount each of the 3 years. we used what little money we had to purchase some store items and more inventory. We were told their sign guy would work with us and work out a deal where we would be able to pay the sign guy a certain monthly amount. turns out this is false! we can not make rent because no one knows we exist without a sign. we cant get a loan for it, and for some reason he is blocking the sale of the store to anyone else. This makes no sense to me as if someone else buys the store and can pay him his money why would he say no to that? So at this point if he dont let us sell we will be forced to just leave the store and be screwed. So my question, then what are our options? I get we would be forced to pay that contract, but it aint gonna happen, no money for it. That being said would we have to file chapter 7, or 13, or is there a way to get rid of that debt without doing that. whats the difference between 7 and 13. Also, would we lose our home or cars since we dont actually own them we are just paying on them?
Glenn- its not an LLC , its under my name and wifes. he hasnt tried selling his self. he has just said i can not sell because the agreement on the contract was with us. even though he told me before signing i could sell as long as they approved the buyer. this is another frustrating point. what happens if he wont let me sell and he doesnt sell the property? am i then entitled to pay? and if he does sell the property but after im evicited, do i still have to pay? if so can there be options for me to get out.

My mom is lazy. She has a part time job but it is for up to 3 hours a week. Whenever I want to do something she tells me to either do something for her or go do my summer projects for school or go to bed. All she does all day is watch TV or does her favorite hobby, jewelry making/beading. My dad works very hard everyday and when he comes home he is tired but my mom doesn’t always make him dinner. My sister is in a wheelchair and has to be feed by us, but while my mom is watching TV or beading she will tell me to feed her (which can take 30+ minutes). My dad owns a small business and the recession has hit us hard so he hasn’t take home pay since February of LAST year, but my mom is eating up our savings by buying beads (sometimes 0+ a month). My dad has tried to close one of his business that is not making any money, but the corporation it was licensed by will charge him ,000 if he doesn’t have 3 of them branches open. He used to have 5 of these businesses and also a joint owned one with his ex-wife, and also one other business. With my mom spending all of this money I am concerned that we might have to file for bankruptcy and leave over 100 people jobless. We also provide housing to 1 of our employees but if the businesses goes under he will be homeless. My mom also doesn’t clean up around the house so it is in a huge mess and it also has tons of junk in it (my room is waist deep in my mom’s stuff, except for a small path; I am not supposed to mess with any of it). The next problem is that my mom screams a lot, esp. if I don’t want to do something she asks. Another thing is I get good grades and work very hard in school (all A’s) but she yells at me if my grade starts to go down. My dad has privately told me that he has thought about getting a divorce if she doesn’t start doing stuff around the house. Another thing is that my mom said something to my aunt (who is bipolar) that has put up an 0,000 lawsuit against us over inheritance and I haven’t seen my cousin or uncle in a year. My grandmother is 88 and has gone delusional and the rest of my grandparents are dead. Do any of you have a solution to any of these problems?
