Green Card through Marriage Fraud?

I know someone personally who has been in the US for around 9 years now and got married to an American for her green card.She’s waiting for her citizenship now, which she told me will get next year. The American man doesn’t even live with her, but she calls him to visit her whenever she decides…maybe knows the days/time the immgiration might check up on them…don’t know.
The woman also keeps that American guy in her office (working together though living separately) and always tells me that once she gets her citizenship she will kick him to the curb from work because he gets on her nerves. Now she’s dependent on him so can’t do anything about it. Number of people around her know that she entered into a fraud marriage, so definitely not a secret in her circle plus she lives with her son, thoough keeps fake albums of her ‘husband.’ Is it too late to report her as she’s waiting on her citizenship next year? The woman also sometimes on documents uses adifferent last name which she claims she will change into later on..but hasn’t officially changed it yet though keeps using it at the same time she uses her real birth last name. She also does what’s known ‘unauthorized practice of law’ when she deals with immigration just with her notary certificate and then gives the forms to a lawyer she works with to get the docs signed for her. As far as I know, only lawyers can fill out immigration forms, right? She also filed for bankruptcy years ago so the consulting office she has opened where she deals with the new immigrants who need help with paperwork and dont know shit about the country/laws, that office is under someone else’s name as she has no credit history herself now.
I also saw that one of her clients forgot to sign part of a doc, so she later asked her receptionist to sign it before sending the green card forms of that client off to the immigration. She also opened up a business within her small office where she supposedly find people for a marriage…as in a dating office, but the real intent in that is that she hooks up people for a marriage for a green card/paperwork. So do I have any chance in reporting this…and where exactly? I heard that many fraud marriages don’t even get reported on, so I’m kind of hesitant in reporting this knowing that her citizenship is in process now and that the authorities might not even do anything about it. What will they do exactly….? Just go to her place and check to see if her ‘husband’ is with her and that’s it?

The woman has hurt numerous people (newcomers not knowing the laws, including me minimaly though) and I feel like it’s a pay back time for all of her sins as she’s only exploits people. So any chance here????

Complicated question but easy for lawyers or marshalls or those in law enforcement.?

TOPIC: Civil lawsuit and Enforcement of a judgment thru a "LEVY"? Search and seizure. Exactly how does this work?

INTRO: my cousin owns his own business, but got sued by a larger company who is a known bully in the field and basically accuses small companies for stuff they didn’t do because the judge in his town is "buddy buddy" with them, i don’t know the arrangement and can’t prove it), but they basically swoop up the entire market share in his field one-by-one by knocking off these small companies with bogus claims in high courts. He couldn’t afford an attorney but they brought 4 of them as they do in all their cases apparently. Here’s my question:

QUESTION: He lost the case and it’s some ridiculous amount he’ll never be able to afford. It’s going to destroy his life and his family’s, but he doesn’t want to have to file bankruptcy (for a number of reasons…at least yet). He was asking what happens if he doesn’t/can’t pay and they sell the judgment to a collection agency/lawyers who specialize in capital recovery and the like. He doesn’t own any property but has built up a sucessful online company from his apartment and is the most honest, hardworking guy I’ve ever known. His company is popular because of his line of products and his customer service but he’s only been doing it for 8 years (I never see him anymore). He has 3 kids he’s trying to put through college. However, If the civil judgment is for a crazy amount (5,000) and he owns no property except what’s physically "in" his apartment, once the lawyers sick the collections agency on him, he and his family are worried that the same judge will just sign off on anything they put in front of him, based on the case so far. Their fear is that the lawyers will just get get a lien on his business (auction it off, even if no property, auction of the trademarks and all that stuff he’s worked hard to build) and bring it over to their company like they’ve done with the other lawsuits.

From his research his fear is that they will get a search and seizure (not sure the term) and go in and take ALL his family’s stuff (we know there are exemptions), but like take his safe etc which has all his trade secrets and kid’s future college tuition. He knows not to put it in the bank because they could levy it all in one day. If they don’t know he has a safe per se, WHAT IS IT CALLED (AND EXACTLY HOW FAR CAN THEY GO) can they get some sort of "general" lien/search and seizure where they can go in (knock or barge in–don’t know) and take anything "of value" / to pay back that civil judgment where they then sell it at auction? Do they "have" to have items named, like safe, or can it just be "go in and get anything over a certain value". We all know/have seen those public auctions wher they’ve gone in and levied (???) people’s stuff. He’s renting his apartment with his wife, their 3 kids, and his wife’s brother in-law who recently lost his job and they took him in.

Sorry for writing too much, so basically this question is about enforcement of a levy (other than bank/paycheck because he works for himself). Just need to know can they levy what’s in his apartment, do they have to knock, does the search and seizure (not sure what it’s called in this case) have to "specify" items that can be taken (can items even be taken?), auction them, etc. Also (another question) can they just slap a notice on his front door and auction off his business? (you know who will be there to buy it too). Also, is it the local marshalls who do this? What kindof paperwork would they need? Whatever detail you can provide would really help. Thanks so much.
J.D.–Nice try (actually REALLY nice try) but the problem is the type of lawyers who participate in this type of behavior (actually any/every type of copyright lawyer) are the same types of lawyers who immediately whip out "FRAUDULENT TRANSFER" body of law in all its beauty. Then the court just says it’s still really yours, so you’re little IOU trick doesn’t hold water in the end. Like I said, nice try. We’ve all thought of that one. Yes, people do it all the time, doesn’t really work unless your attorney is in 5yo or something. In fact, one of the "badges of fraud" is that the purchase amount is not commensurate with the value (ie ""). Still it’s the best answer, and will probably remain the best answer). A second "badge of fraudulent conveyance" is when you sell it to a "closest family member". There are many. The "average Joe" doesn’t know about them, but then again, the average Joe isn’t CEO, and if he is, no one really wants his business in a "hostile takeover" / back door type

Madoff Had Wide Role in Mets’ Finances

When Fred Wilpon’s son Jeff was married at Fresh Meadow Country Club on Long Island, Bernard L. Madoff and his wife were there. When Mr. Madoff’s son Mark was married at the same country club, Mr. Wilpon, the principal owner of the Mets, was a guest as well.

When the Mets negotiated their larger contracts with star players — complex deals with signing bonuses and performance incentives — they sometimes adopted the strategy of placing deferred money owed the players with Mr. Madoff’s investment firm. They would have to pay the player, but the owners of the club would be able to make money for themselves in the meantime. There never seemed to be much doubt about that, according to several people with knowledge of the arrangements.

“Bernie was part of the business plan for the Mets,” a former employee of the club said.

Since the day of the disaster — Mr. Madoff’s December 2008 arrest for orchestrating a billion Ponzi scheme — Mr. Wilpon’s relationship with Mr. Madoff has been generally acknowledged but not well understood. Mr. Wilpon and his family have offered scant details about the friendship, except to indicate they felt deeply betrayed by the scam and were harmed financially.

Now, however, a lawsuit against Mr. Wilpon and Mr. Katz brought by the trustee for victims of Mr. Madoff has suggested the relationship — financially and personally — was deeper than anyone might have suspected. The trustee, Irving H. Picard, has alleged that the two men’s dealings with Mr. Madoff were extensive and longstanding, and that they went on even after suspicions about Mr. Madoff’s operation were raised, according to two lawyers involved in the case.

As a result, according to the lawyers, Mr. Picard has asserted that Mr. Wilpon and Mr. Katz either knew or should have known that Mr. Madoff’s operation was a potential fraud. Mr. Wilpon, Mr. Katz and their lawyers have refused to comment on the lawsuit, which was filed under seal in December in federal bankruptcy court in Manhattan.

But interviews with current and former associates of Mr. Wilpon and Mr. Katz, as well as former employees of the club, former employees of Mr. Madoff and others, make it clear that the relationship was substantial and that the role Mr. Madoff played in the financial life of the ball club and the Wilpon and Katz families was pervasive.

What happens after a Chapter 7 bankruptcy is final?

I’ll leave out the details but I am almost certainly going to file. Already spoken to 3 lawyers and picked one. Would like to hear from folks whov’e been through this in the past. I’m curious what "life is like" after it’s all said and done. Do you have regrets? I never in a million years thought I would be ever filing bankruptcy but I started a side business 6 years ago and it’s failed in this economy. And I’ve spent every penny I had saved up.

I’ve been told after it’s discharged, you will be able to get a loan to say, buy a car within 6 months? And a mortgage within a year? (I need to re-fil my home on the lower rates).

Legal Question: RE: Chapter 7 Bankruptcies?

I’m about to start a Chapter 7 bankruptcy petition preparing business and I needed to find out a few different things before I get bonded and registered with the county clerk’s office next week.

1) Since a legal document assistant like myself can not delegate legal advice, would a prospective client/debtor have to find out if he/she qualifies for Chapter 7 BEFORE coming to me to fill out the client questionnaire and have me fill out the petition, schedules, etc.? If so, do they need to go through an attorney to do so, or will they be able to tell based off of their existing real and personal property, income and debts?

2) What type of affordable Chapter 7 Bankruptcy software is available to non-lawyers (legal document assistants like myself)?

I am aware of the limitations placed on legal document assistants (fee caps, inability to delegate legal advice). I only need to determine the two aforementioned pieces of information and then I will be able to start work asap.

CPAs and Attorneys: Law degree vs MBA?

I am a CPA with 3 years of experience in tax preparation. I am trying to plan my future and career. Any other CPAs / lawyers that can help share opinions or their stories please help.

I do not know if I want to eventually open my own tax service, or somehow narrow my focus to large companies and/or transactions. With this approach I would not be stuck in the "corporate world" and "office politics". I would work hard but reap all of the results. – I guess I could do tax or go to law school and be an estate/trust attorney, or bankruptcy, business formations, something to leverage my accounting background.

On another note, maybe I should head for the industry and work toward executive level opportunities in the future.

Any input is appreciated. I’m still not sure what it takes to reach the goal I decide or what to expect.

Where would I go to receive an honest advice on my tough financial situation and debts.?

I’m a RE agent and the only one at the family who works however I have not been making any money for 6 months! All my 4 children and my wife are students. We have been living a good life with a family of six since. We own three properties including my home. My efforts to sell any of my properties including home has not been successful. We have been using our credit cards and have max them all. As a result of this situation I am not able to refinance or obtain any other loans.
As a business person, I have started to set up another business which I can replace with my current career. It may take at lease six months to make money.
I have other valuable items that may bring me money if I sell them but those also take time.
The situation has kind of depressed me. What should I do in this situation? I spoke to a lawyer about filling chapter 13, but it looks like most lawyers like chapter 7 better. I know I can get back to my feet if I would have enough time to reestablish. please help!

How do apparently succesful buisnesses get into chapter 11 bankruptcy?

I just Found out the Flying J truck stops corporation is in chapter 11 bankruptcy. My question is this. Freakin HOW ? Every flying J truck stop I have ever been to has been busy . Really busy. And their prices are High compared to a neighborhood convenience store. And they get their money too because truckers HAVE to go to truckstops. I will get an energy Drink, a crappy burger and some potato wedges and be out 12-13 bucks easy. Not to mention the 500bucks in fuel my company just bought from them.

When some businesses like the restaurant down the street go under it makes sense because, hardly anyone eats there. But several times I have seen successful businesses like the PUMPHANDLE convenience stores go under

How do these businesses that have tons of customers and make tons of money manage to blow it ? Are they paying some Fat*ssed vice president of the company too much money to play golf on his 3 hour work day? Or are lawyers getting it from law suits ?

How can I (US citizen) and my fiance (Mexican Citizen) move (permanently) to Canada?

Basics of the story: I live in Oregon, my fiancé lives in Acapulco. The US is NOT helping us start our life out together. We want to move to Canada, ASAP, permanently. We’ve looked in to the country, and feel it is an incredible place to build a life. We are ready to move there, today.
There are some issues which are making our lives difficult. As with most issues, some are our past errors in life, and some are purely situational. We are two humans, trying to make a life together. We are not perfect. We have made errors. But we both feel we have finally found eachother, and there in, a reason to Try in life. We just want to live. Together. Somewhere we can both be legal, respected, equal citizens.

Here are the negative issues which should be taken into consideration:
-Neither of us have a substantial amount of money
-I have a k tax lien w/ the US gov (due to my parents, LONG STORY. I can file Bankruptcy to get rid of this, if it will help our case.)
-My fiancé was deported from the US.
-He has a “menace threat” on the records from CA
-He is not fluent in English nor French
-He has not completed the “Matricula Conusular”, I believe that is the equivalent of not finishing High School.

Here are the positives which should be taken into consideration:
-He was in the military for 5 years in Mexico
-He has served in the Police force in Mexico for the greater portion of the last year
-I am bilingual in English & Spanish
-We are both capable and hard workers
-I have worked in the banking/mortgage business for years
-He has experience as a cook for years, in the army, and out
-We are both 100% dedicated to starting anew, and will do whatever it takes to find somewhere which will allow us to do just that, together.

The largest positive, however, is our (cheesiness warning) love for eachother. We want to raise a family. I have been told by lawyers to move to Mexico, if we really want to be together. If no one else follows the news in Mexico, as it rarely reaches English news stations, google Fernando Marti, or, read this article: http://seattletimes.nwsource.com/html/nationworld/2008112652_mexico14.html. Crimes of this nature occur all the time. Not to mention the drug conflict is verging on a full blown war in Mexico right now. As a police officer, and part of the military, my fiancé knows only too well the realities of a nation at war with its own corruption. And we both know, it is not where we want to start our family.
Any help would be incredibly appreciated. We very much wish to move to Canada, as my family lives in Oregon, US, it would be a 5-6 hour drive for them to visit us. But if Canada will not have us, we are looking into France, Spain, and Italy. We’re just two people, who, like most people, have pasts. But, I love him. And am only asking for the chance, to try. How to structure a deal for people investing in my LLC?

I own a housekeeping service
I want to use OPM (other people’s money) to fund my business.
I purchased a coffee shop several years ago, ad while it was a great idea, the anchor store for the place I was attached to closed so I had to file bankruptcy (I had a lease and various other obligations that I could not escape).

This time around, I learned and won’t be sticking my neck out all the way without other people’s necks at least half way out as mine lol.

I have been in business for a year. I am creating a business plan. Marketing methods I have used are all free or relatively cheap and it has rewarded me with steady business. I thnk if I were to spend money on marketing our brand, we could get a lot more customers Plus I am operating in two markets.

I want to be able to structure a deal for people who want to invest in my business. Of course, I’m running an LLC, not a C Corp so I can’t do any IPO or anything like that.

My problem is I don’t know how to structure an investment deal: do I structure a repayment plan like a loan, with interest? Do I ask for the money in increments like an investor promises k over a year but to be given at 00 per quarter with an expected return of 00 after two years.

PLEASE help! reccomend me a good book about getting investors without involving a million expensive lawyers. I want to be very basic. I just want to be able to show how our business has performed over the past year, show our business plan and ask for their money. I want to avoid loan-backing my business. I don’t want to ever bankrupt myself or anyone else again.
TO Mr. Top Contributor who answered my question: I don’t think It matters what the money is for. Maybe I want to buy 10 Hybrid vehicles to run my green business. This isn’t a business presentation; it’s a simple question. I don’t know how to structure a deal so that I get capital and investors get a return from profits. That simple.

Lawyer Help: what's the worst that can happen?

I took out a business loan for 10grand and a personal loan for 7grand BOTH from my wells fargo bank. I’m having trouble paying it back and these collectors are telling me that they will get their lawyers and take me to court if I don’t pay it back. I agreed to make monthly payments instead of a lump sum because I do not have the lump sum. I’ve been paying them back for 2yrs now. I missed one payment from both loans and both collectors said "We’re glad you called us back because your claim was ready to be overlooked by our lawyers…blah blah"

1. First off is that true or are they just harassing me?

2. If it’s true what is the worst that they can do? Garnish my wages (whatever that means)

3. Will I have to file bankruptcy and will I lose my car if I do that??

4. What will happen if I just ignore them??

(Please try to answer all those questions)

Medical Assistance when there is a bankruptcy filing underway?

I’m looking for answers from those within the legal/medical community.

My husband owned a business for several years. When he became seriously ill, the company took on significant debt. Eventually, he regained much of his health, but his company still went out of business. He met with several financial advisors and lawyers, and they came to the conclusion that filing for bankruptcy was the only thing he could do.

He has another job now, which is a Godsend, though it pays him half what he made when he owned his company. The unfortunate thing is, it offers no health insurance. Neither does my job. I applied for a state run health assistance program, but realized that to finish the application you need a copy of your most recent taxes. Because my husband is still in the filing process, we didn’t file 2008 taxes.

He’s not dying anymore, but his immune system is still recovering from his illness and he gets sick a lot. Our medical bills are threatening to drown us in debt, and I am wondering if there is any program that offers help for people in our situation?

What is the best way for a man to convince women to?

What is the best way for a man to convince women to voluntary give him 50/50 custody of a baby with out going to court, that give both parties legal protections. The man would be willing to wait until the baby is about one year old to get 50/50 custody, neither party has to pay child support to the other, but can. The man would also be willing to live with the woman if that is what she wants.

Would the tread of a legal child custody battle that cost 30,000 do the trick if it could last over two years? He will try to prove that you are unfit mother, and even if you are a good mother, you can still easily lose custody if he can prove he is the better parent.

Would a woman also do this, if the man will fee the country on a foreign passport and never comes back to America? He also has a US passport. If the person is willing to spend the rest of his live in jail you will not get any money from this person any way, especially if he is willing to prove it. You can’t get any child support from guy that does the following, any lawyers tell you. You can’t take a Belgium passport away for not paying child support according the US State Department.

Even the IRS will settle for pennies on the dollar, if the person owes Federal Taxes, if all his money in a Swiss bank account. They can get his money unless he voluntary gives them some. Businesses will to the same and settle for 20 cent on the dollar, because if the guy files bankruptcy they will get nothing any way. The same way goes with child support.

I’ll just list the facts. My case is very complicated.
* My house is located in Staten Island, New York
* My house is one of 28 in Home Association (HOA)
* My house is one of 9 that facing the water
* In 2007 Nor’easter hit and retaining wall has collapsed
* 9 families were ordered to evacuate by Department Of Buildings
* Since houses did not have any damage besides their back yards, home insurance did not cover the damages
* Same time FEMA declared Staten Island a disaster zone
* We were suppose to get .5M Small Business Administration loan,
but never did because of the fact that other 18 homes refused to take it
* To repair the wall we need to spend millions that we don’t have
* It has been 2 years since it happened and we suffered unimaginable hardship. We had to live in very poor conditions renting or living with relatives and continue paying mortgage
* We went through 5 lawyers spending tens of thousands without any success to get back to our homes

Now is the question. At this point there is very little hope for us to get back to our houses. We used up all possible legal ways and exhausted financially and emotionally. Personally I’ve put down all my family’s savings for this house and still owe over 0K to the bank. What options do I have to walk away from the property?

* Builder is nowhere to be found. Plus it’s been more than 10 years since construciton.

We are having a hard time recooping our money in escrow?

Bought a home in July of 2007, there was 5k put in escrow that was suppose to be put in a non interest bearing account for the completion of a roof deck. The roof decks will never be build do we sent a request 2 months ago thru our lawyer to have the escrow released to us, so to build the roof decks ourselves when the condo building is in a better place. Meaning there is only 8 of 37 units sold at this point, empty building, bankrupt developers and getting a hard time stating the money needs to be relased thru their bankruptcy, when it shouldn’t have anything to do with their bankruptcy and it should have been put in a 2nd account, not in their pocket.
We are getting the run around like no ones business. the developer is a crock and we have hired a lawyer thru the current owners in the building to help with other issues but we are the only ones with signed papers that the money would come back to us if the roof decks were not to be completed, now I think he pocketed the money? HELP
They signed that the money would be returned if the roof deck was not to be built. It has not after 9 months. They kept promising us, I know it is illegial for this and I would love to get them disbarred. My lawyer is having a hell of a time even getting the sellers lawyers to call him back let alone move forward.
I have called, emailed, sent certified mail..Nothing
We do not have the extra money to hire a lawyer to strictly handle this..

Help a friend stay off the street?

I have a girlfriend who is in her 30’s. She is a good person was sucessful with her career, had money, a nice place to live, and had a strong future in front of her. started own company, had money stolen from her in business,IRS audit and bank account sucked by irs last year leaving her with limited money. She then had home office and a employee had stolen a lot of her valuables. lost a long ex fiance who was part of her business problems and lawyers. Due to long work hours lost most of her friends…She has small family and no kids, husband or boyfriend. She has informed me with dignity she has 2 hundred dollars to her name, pets her lease is to expire end of month and was in ex fiance’s name, pre-bankruptcy credit and no bank account. To make things worse her family can’t help her mother is dying and has demdnsia. Sounds tragic she wishes no pity told me will be on the street at end of the month. She is so dn in luck and could not get out…No drugs, ect…Nobody knew.Wt would you
She is not lazy or wallowing in pity. I have noticed over the last year she has been trying to salvage what she has had and I was told she has had a hard time getting a job in our big city especially to keep afloat and pay debts off. She was used to commission jobs which paid good money and now she has sold most of her stuff, ect. She is in her late 30’s. I know she is not lazy or a loser.I am thinking of letting her stay but we are not close anymore probably due to her dealing with this alone but I am also afraid this will be too much for me…Should I lend her money? Rents start at about 1000. Here in los angeles and I don’t think due to credit, no money in the bank and her dogs she can rent at most places. Her dogs are small and her life..

Unable to file bankrupcty, still need legal advice?

I need legal advice on how to handle a debt problem. I owe ,000 to 3 USA credit cards each, so a total of ,000. I am broke, but according to all the lawyers that I have consulted (all of them belong to the California American Board of Certification, the national certification board for bankruptcy, or the ones rated on the Best bureau Business,) tell me that I can file for bankruptcy, but the judge will not allow the debts to be discharged (Is a long story and all the lawyers ask me why and once I explained them, they agree that is not advisable).
I have lived a hell suffering because I think is not ethical to avoid paying, but I am broke, my plan was not to do this, they offered me credit cards with balance transfer and I used them as a way to borrow money while I was solving my problems here, but things did not worked the way I planned and suddenly I cannot obtain more balance transfers and the debt is there but I am broke.
So, I am not looking for a lawyer to file bankruptcy, I am looking for a lawyer that answers my questions that I will have through the collecting and suing process.
I am Mexican, I have lived in Mexico the last 7 seven years of my life. I do not have any assets in the US nor in Mexico or anywhere, I do not have any assets at all.

The same lawyers that I have contacted, I have asked them for a legal consultation, but, they do not offer that, some of them have suggested me to look for a lawyer with practice in the debt collect law. So, my first question is where to look for a reliable lawyer. The questions that I have right now for this lawyer are below, just in case you want to give your opinion if have had any experience on this.

What happens if I answer the call and tell them that I will not pay them?

If I tell them that I do not have any asset in the USA?

And I am not living in the USA?

And I am broke?

I am not American (this may cause that the bank send a notice to migration)?

They may find out that I have some relation with that address in California is that a problem for the people that live there?

Are they ever going to go the California address?

They may find out my address in Mexico, is that a problem?

If in the future I want to go to the USA, Will migration sends me to jail or does not allow me to be there?

How long does it take from the initial of collecting until the release of charges from being sued?

What happen if they sue me?
