Dear diary, today was awful, mum took me to see a lawyer, for some reason people think the old creep should know what happened. I disagree it’s my business. People say he could help. Help with what? Prove that I’m normal. Anyway here is what happened.

‘I’m afraid I can’t help you if you can’t tell me anything else’ said a very important looking man with a trench coat on and big round glasses which someone would have worn in the 70s. (if the matter didn’t matter so much to my mum I would have been calling him Paddington bear.)
‘Are you listening to Mr Saddler, Amy? This is very important; you need to be paying attention.’
‘Amy, can you tell me everything you remember?’ said Paddington
I kept my head down. I didn’t want to talk to him about “the incident.”
My mum then got into a bit of a fluster “Oh Amy when are you going to start helping yourself, your just getting yourself into a deeper hole, you childish girl” thankfully I had heard this speech before so I didn’t get too embarrassed.
Then the dreaded you need to go into a small corner and think about this, speech came.
‘Mrs Mont, I suggest if you want any help you tell your daughter to think very carefully over the events that happened, otherwise there is nothing I can do.’

Pointless isn’t it. After reading that you’re probably wondering why we were there in the first place. Well I’ll tell you something, you don’t know what’s going to happen in your life on your first birthday, so you’re just going to have to read on past the first chapter.

I can’t write much as I’m suppose to be in bed, but just to fill you in, boy did I get an earful at dinner, it was coming from both sides, normally it goes in one ear and out the other, but oh boy not tonight, I had it from both parents ‘if you don’t tell Paddington what happened no iPod or computer for a month’
‘Hey Barbara don’t forget the sky card’ added the demon step father. Honestly, if you were just walking down the street and you saw him walking towards you, you’d run a mile, with his ring of fluffy hair just circling the outside of his head and his eyes set too close together. The first time mum brought him home, I ran round the house screaming aliens, aliens, I thought we were going to be abducted.

Sorry I didn’t write yesterday I didn’t have time but to make up for it, I will tell you the first part of ‘the incident,’ this is what everyone is talking about, so if you want to be in the ‘in crowd’ you better listen carefully.

Well, first I better tell you how I ended up in England, again. Originally my family was from England, however, 10 years ago we moved to America for my father’s job, unfortunately he got made redundant last year and well that was the final straw for my mum, she was sick of having money problems and being away from her family, so that night she packed up mine and her bags and we jetted of back to England, and that was the end of my parents marriage, the end of America and the end of this story, well for now anyway.

i’ve been charged with violation NEW YORK PUBLIC SAFETY LAW 10-131,G,1 by selling 30 imitation firearms.
A silver-colored plastic gun and muzzle in red paint on color.
I consulted the wholesale sector, they told me that the item can be sold legally.I do not know if I am not innocent, because I do not understand the law, why the Government did not give small businesses the law made the manual.
The most i would like to know about whichs how much money will be fined? I do not know why small businesses will be selected,Now the economy is so depressed and my business is getting worse every day are at a loss, too much to pay if I can only apply for a bankruptcy.
I would like to know what can or should i do next?
To find a lawyer or directly to The Legal Services Division Center?

We fell on some devistating hard times due to illness, medical bills, ect ect ect. After our only vehicle got repossessed we sifted through hours and hours of online and phonebook ads for bad credit loans to attempt to borrow some money so we can get vehicle back. Seems either they’re all payday loans of small amounts that aren’t big enough to do any good with insane interests or just total scams. Its been exhausting and very depressing. So now we realize that the only answer is to file for chapter 13.

Just as overwhelming is trying to find a good BK lawyer. How do you sift through all the generic ads to find a good one? We don’t have a lot of time for testimonials as we’ll have 3 business days to find one and get working to save what little we have left.

My husband is going to buy a new car and is going to trade the car that has both our names on the title as "or". I have hired a lawyer to file bankruptcy for my business. My husband is not filing bankruptcy. Will this be considered fraud or what kind of problems will this cause if he trades this before the bankruptcy is started. When he buys a new car my name will not be on the title. Please let me know what to do. I will try to contact my lawyer next week to answer this but I will be crazy about this before then.

I’m a RE agent and the only one at the family who works however I have not been making any money for 6 months! All my 4 children and my wife are students. We have been living a good life with a family of six since. We own three properties including my home. My efforts to sell any of my properties including home has not been successful. We have been using our credit cards and have max them all. As a result of this situation I am not able to refinance or obtain any other loans.
As a business person, I have started to set up another business which I can replace with my current career. It may take at lease six months to make money.
I have other valuable items that may bring me money if I sell them but those also take time.
The situation has kind of depressed me. What should I do in this situation? I spoke to a lawyer about filling chapter 13, but it looks like most lawyers like chapter 7 better. I know I can get back to my feet if I would have enough time to reestablish. please help!

I never saw or spoke to a lawyer, they filed chapter 13 bk for me which failed..Dismissed For Incomplete Filing, no pay plan submitted.They denied it saying it was a COURT ERROR but they "can’t argue with the court" so I have to start over–Refile and pay filing fee again out of my pocket!Meanwhile, the sale date is coming up
They prepare docs again, just barely in time, and they have ME file it myself and pay the fee directly to the court. I still hadn’t seen a lawyer but I was told I will "when it is time". They said I don’t even need to go to court, so I didn’t, and neither did a lawyer either! Case Dismissed For Failure To Appear and I can’t refile for 180 days. Still no lawyer and they tell me they are moving, changing phone#, FAX#, and the business Name, too.
Now my property is unprotected, I don’t know what to do and the bank takes my property. Is there anything I can do? Can I hold someone responsible?

Also I have not received anything in writing yet, and I have one rental unit and the renters have not received anything in writing either, Do I still collect the rent until I get something in writing from the bank?

I had a civil complaint filed against me and my partner a while back. I retained a lawyer for ,000 but when the bill arrived from the following month for another ,000 I was pretty much in over my head. Economy was going down, bills rising, customers cutting spending, etc.

So I told the law firm I was broke and probably going to file bankruptcy. He said that would "stay" the suit and he quickly moved to be dismissed with the court as my attorney… since I could no longer pay.

I got a letter that said I had to respond in 30 days to proceed pro se, but I misread it and thought it said they would consider me pro se if I didn’t hire a lawyer in 30 days. So I basically defaulted on the suit. That was last October.

Now it looks like I may not need to file bankruptcy. We cut expenses, got food stamps, medicaid and I am working my way back up slowly but surely.

This lawsuit is meritless. It was a client who wanted to return k of computer equipment 3 months after purchase because he want out of business. He is a former attorney and is just trying to cause us pain. I can’t afford to fight it. I cant afford even a consultant.

I am not sure what I should do as my former partner has a lawyer and they want me to give depositions, etc to help him.

What should I do???

I had a contract on a house that was put in back in March 2010 it was a short sale and I waited two months for Wells Fargo to reply to the offer, before they could reply however, the seller decides that he doesn’t want to sell the house after all, his lawyer had advised him to file bankruptcy instead. Will the fact that I had a contract in before the deadline on the $ 8.000.00 carry over to new property that I decide to buy, or am I just out of luck due to this persons disconcerting way of doing business? Since I wasn’t the one that backed out of the contract, shouldn’t I still get the benefit of the incentive on my new property?

-my wife got hit by a car while riding her bike on the sidewalk.
-we got a lawer to handle the case.
-he got her going to a chiropractor
-she was seen by an orthopedic surgeon and he found she had a torn miniscus
-she wasnt on my car insurance because she doesnt drive, although she has a driver license for identification purposes.
-the lady that hit her’s insurance was geico and the we requested them to tender policy limits…which are ,000
-they approved it and the release was executed.
-the hospital bill one night came out to ,000
-the 10 min visit to the orthopedic was ,500.00
-the therapy for 3 1/2 mo was about ,000
-MRIs are about another 00
-and the lawer fee ,333.33
-my insurance paid about ,000
-unfortunately we do not have health insurance.
-if we go after the lady that hit her, her only asset is a house that costs about 0,000 in the market right now. The lawyer suggested not to because the lady could just file for bankruptcy…she recently had forclosure on her home.
I feel were getting ripped off.
-I want to know what can be done so my wife is not in dept and her credit doesnt get destroyed…I feel our lawyer could care less what happens to us, he just wants his 1/3. the check for 10,000 came in from geico and he had us come in to sign it. He says he is going to try to negociate the amount that we owe from the different parties . we going to probably end up with less than 00. This has really affected our marriage because not only is she still in pain she lost her job but we are going to be in more dept than we already are. She didnt choose to get hit by that car riding her bike on the sidewalk. how much control does the lawer have of our money after he deposits it? once the check clears "7-10 business days" we have to come back and sign this paper stating what is owed… Does he get total control of our money? Say, can he still pay off his medical buddies without our authorization? I dont care about his part. I will pay him with no problem… What gets me is paying his medical people which he recomended to us…the chiro just touched her back less than a minute and they would just put heat pads and electricity. they never really did physical therapy massaging or anything. What did we get out of our misfortune? That for doing the right thing after an accident, getting an attornery. He just played the cards for the insurance to pay, then for him to pay off himself and his recommended medical specialists and we get hardly no compensation for the pain my wife still suffers after accident and our lost wages? This is crazy. What can be done at this point? I would not want to work with this lawyer again because on several occasions he was nasty to me over the phone telling me my "case just sucks", and scolding me ‘how could i not have health insurance for my wife?" I told him i dont even have it myself and neither do 47million americans.

i owe wells fargo for a personal AND business credit card. total about 20k. (was expecting 40k that i overpaid on my taxes that i’m not getting…blah, blah). anyways, i offered to pay them whatever i could and they told me not to even bother unless i was going to make the minimum payment (which i can’t afford right now). they said when it reaches 90 days overdue that they will either send me to 3rd party collections or take me to court. my questions:

1. which do you think they will do?
2. should i even bother paying what i can a month or listen to them and not pay anything?
3. they say that after 90 days it will affect my business credit. isn’t my business credit already screwed? if i pay them at least something will it still affect my business credit? will it stop them from sending me to court or collections?

i’m not going to declare bankruptcy (already spoke with lawyer)
i’m hoping things will pick up business wise soon and i can start repaying my debt.

i also have 3 other credit cards i owe on and an office lease i got out of. total debt about 75k. they won’t work with me either, i already asked them. thanks.
also they call me about 30 times a day and even after i call them and tell them i can’t pay the calls from them continue. they will call me 5 minutes after i spoke with them. can they do that? they also call my brother in law (don’t know how they got his number cause he has a different last name) and my mother and father multiple times a day and harrass them.

We own a franchisee. However we are so much in debt now we are forced to file for bankruptcy. We are filing personal bankruptcy because the business debt is personally guaranteed and we also borrowed from our personal cards to put in the business.
the Franchisor is the sub-leaser of the place. We are behind two months on the lease and owe the Franchisor royalties. Now we have closed the shop and the franchisor wants the keys back, because the lease is under their name and because of the owed royalties.
we removed all assets that we could physically remove.

They told my lawyer that they know I don’t have any money to pay so they’re not even going to sign an agreement that I am transfering the business over to them.
they said they’re going to go to court and ask the judge to have me give them the keys.
I will give it to them but I want to be sure they’re going to be able to do anything else to us. we don’t have any choice and we have no money. they have the upper hand now.
What are they able to do to us? and after I hand over the keys can I just dissolve the corporation

also when filing for personal bankruptcy does my corporation automatically fall under that? does it get dissolved?

My wife’s family borrowed over 0,000 to help out with their farm. It was against my better judgement to loan them this money, but it’s too late now. So they took this money, essentially wasted it and now they’re more or less going to lose the farm. They’re trying to sell it, but it looks like it’s too late for that.

Last month, the bank refused to renew their commercial loan and it looks like they’re about to foreclose.

Am I basically S.O.L. now? Or do I still have a chance to put a lien against the property to get my money back?

I have a feeling that if I want to get my money, or at least some of it, they have to file for bankruptcy first. But isn’t it too late for that?

I’m looking at talking to a lawyer, but I’d just like some idea of how this works. I don’t want to spend the money and then have the guy tell me there’s nothing I can do.

I live in michigan and have filed bankruptcy. Due to my employer closing some locations i lost my job about 5 months ago, with that i lost my health insurance. I had a major medical emergency that came up and have hospital/doctor bills totaling about ,000, so I was left with no other choice. I have a daughter and have 50/50 custody w/ her mother. We were never married, never had any joint accounts together, no house together etc etc. I pay a month child support and am currently overpaid on my child support by over 0 due to a "computer glitch" as friend of the court calls it. I know child support does not get put into bankruptcy. My lawyer called me today and said he was finalizing everything and that he needed my ex’s address because he has to notify her that I filed bankruptcy. I questioned as to why she had to be notified and he said he was doing it just to be on the safe side. on the safe side of WHAT?? as I stated, we had nothing together and this bankruptcy has nothing to do with her. Why would she have to be notified?? I do not want her to know that i am doing this and its none of her business of whats going on in my life. Is it a law in michigan that she has to be notified or if i do provide her address to the lawyer can i request that no information be given to her??

Should I contact the lawyer? What kind of lawyer would take my case in Seattle? I’m almost thinking bankruptcy. We’ve been hit hard by the recession, and had to close our businesses, but kept a job that barely pays the bills.

My father-in-law bought the business that he worked at when his boss retired several years ago. It’s now come to light that the owner (and the business) owes more than 20k to the IRS in backed taxes, and its threatening the business to the point of bankruptcy. Clearly, that’s an issue, but what help is there for business owners who inherit such a debt and don’t want to close?

And they’ve already got a lawyer…if that helps.

My husbands in a lot of trouble and because of it I am too. He filed a bankruptcy here in California and signed my name to it.

The cops showed up with a marshell and took a lot of stuff away. Then they locked me out of my own shop so I cant make a living now.

A year ago he was out of a job. His benefits run out. Him and his brother decied to start a lawn business. They used a lot of credit cards from home depot, lowes, tractor co, master card and visa and an ameirican express card.

Adds up to about 65 thousan dollars. His borther lives in Oregon and they bought a trailer using another card an then hauled it all off to his brothers house.

They were suppose to be partners but I never seen a dime out of it. Well this weekend I found out what happen. His brothers keeping the money till hes out of bankruptcy.

I seen the papers he filed and he lied about everything he could to hide stuff. Hes got a big gun collection and its all registered and they took it away. It wasnt in the papers he filed. He bought some jewlry 2 months ago on a credit ccard and they took that away too.

The only thig he didnt lie about was my shop. He made suer to put it in there.

I called hsi ex-sister in law all frantic since theyre close. She admitted to an affair with him an its been going on for a year.

I cant wait to get my lawyer to sue for divorce. That husband of mine is a lying scum.
I talked to my lawyer today an call my parents. Im moving back to be with them and givin up the house and the shop. Everything. Anything to get away from that lier.

I worked for a company for about 2 years. It was a car lot, in which 2 dealerships were owned. After my employment there was done, I filed for unemployment, in which one of the papers that was submitted from the employer to the state, said that I was paid minimum wage. I knew that I was not, and filed a complaint with the state. Since then, the employer closed the dealership that I worked at, but still has the other one open.

The state looked into it, and determined that I was owed back wages for those 2 years. They calculated the amount, and sent a letter to the company demanding the money. The company then said that they do owe the money. However the business was shut down because they could not meet their "financial obligations," and that this amount of money would just fall into that category that they could not pay. The lady at the state office said I need to get a lawyer, because she can tell them they owe me, but she cannot make them pay. She said that I would need a judgement against them to force them to pay. I don’t want to have to pay for a lawyer, when I have all the documents that show everything.

As far as I know, they have not filed bankruptcy.

I have called the federal department who stated that this would be considered a "last paycheck," because it is money that I have earned, and they owe me the money.

What I am wanting to know is:

A: Are they still liable to pay me, even though the business is closed. (Only the other remains, which I was paid from both dealerships sometimes.)

B: What steps should I take now?

C: Any other advise that you may be able to help me with!!

Help!!! my car has just been reposessed, if you been thru it before , please give me some good advice?
They reposessed the car last week, and told me i do not have the option to bring the payments current , they now want the full balance which is k, they also told me to get a loan with someone else, they done doing business with me. I have tried paying my car note on time, but i have had some financial woes lately, raising a little baby by myself without the father’s financial support, so it has been tough for me. My major concern right now is when they will take me to court for the remaining balance, because i definitely will not be able to pay a k car note without having the car, i simply can’t afford it, should i get a lawyer to represent my case against the bank, or should i file for bankruptcy, i never even wanted to file bk, but i may have to……i need your advice, thanks

I have made repeated reports to our county’s Child Protective Services and when my child was very young, to the Police. When she was 4 or so she would innocently tell me things her father did to her, until we took her to the police she closed her mouth. Since then, there have been many people who have suspected things and many C.P.S. calls. EVERY single time, I have been told that she was "too young to be a credible witness" and blown off. I left this man when our child was under 1 year. I left because he was extremely abusive of me. But, because he did not abuse her (a newborn at that time) YET, the state of California, and this county, allow him to share custody with me. I filed for a restraining order when I left him, as a teenager. He found out, before I finished the process, and beat me to it, making up lies to get one against ME, his victim. I, being so young, had no idea what I was about to do…but I told him I didn’t care and that if him and his wife got one against ME, then that would STILL mean that they would have to stay away from me, so why would I dispute it? So, I didn’t object. How I wish I’d have had a lawyer. Since then the courts have referred to the man who committed repeated aggressive partner rape on me, as MY VICTIM and have bent to his every whim. My child accused him of molest, they told me she was too little to be credible. My child showed up repeatedly to preschool from his home behaving "oddly" with unexplained bruises shaped like a hand on her bottom etc (the school’s words) and still….she was too young to be credible and the father and his nearly equally abusive wife "denied" it. Oh…okay..case closed. Since then (here we sit 9 years from leaving him) I have had to, on court’s orders, Co Parent with this man, treat him kindly and "only speak positively" or I’d be in contempt. I have shoved my abuse history into what apparently turned out to be a time bomb inside me, and I now have Post Traumatic Stress Disorder form this. My child tells me on a regular basis that she is afraid of her father and his wife, but she will not speak to CPS because when they talk to her they talk to her AT THEIR house with the wife sitting within hearing range! She has told me they have threatened her into not telling me "their business" anymore but luckily she still burst into tears and told me what was going on instead of letting them control her this way. She has begged me to stop them. I call CPS over and over, and they half ass-ed go out there and ask a couple questions and leave (only going to their house up to a week after I call, casually calling ahead to let them know they are coming). WHAT DO I DO!? I finally lost it in mediation the other day when he sat laughing at me while the mediator referred to him as the "victim" telling me since I was NOT the victim here, I could not request separate mediation which is the Victim’s Right. I am a trained volunteer, also, with the Domestic Violence and Sexual Assault Coalition in our county now. I want to be the voice for my 10 year old daughter, and we are being stifled. What can I do? He is not bruising her…as far as I know there is no proof now (unless the molest she accused him of when she was 4 or so is occurring lord forbid or else…). I am about to lose it. I want to scoop up my child (and my other 3 children and husband I have now) and run away since no one will legally help us! Thursday evening was the most recent time (she’s been at his house since, because he has every weekend with her) she told me "Because I am afraid of him". They keep telling me that because there are no marks, she is "within the law". She tells me she wants to talk to mediators (which I have now requested) but she still feels afraid of her father finding out what she said and asks me regularly if someone is going to tell him. So, I am concerned that she may still hold back at court once she sees that he IS there (even though not in the room). I am preparing her as much as possible and as much as legally allowed without accidentally leading her in any way. Which, I’m sure he is doing his own preparing there as well. Does anyone have any advice or suggestions??? I have no money, by the way. My husband recently got fired and so we are nearing bankruptcy so have never been able to afford a lawyer unfortunately. He has also turned CPS into a little game, since I had called for valid reasons on him, now when I "piss him off" he calls and tells them untrue things; every time they have come out they have declared it unfounded after about 5 minutes of being here and have now red flagged my file as possibly malicious fraud calls (which apparently is not illegal yet in this county or state yet! especially because the calls can be anonymous even though they are quoting what he just screamed at me the day before).
