I want to study law, but I do not want to become a lawyer.?

Hello, I went through lots of problems last year. I thought if I knew more of those laws….. about business, credit, bankruptcy and so on, it would have helped me alot.

I do not have plan to be a lawyer, but I would like to study those laws that would help me in long runs.

How should I study them?

We bought a house on land contract 2 years ago and now the owner is filing bankruptcy. What do we do?

We bought a house by land contract 2 years ago. We have never missed a payment and the mortgage is, as of now, paid up to date. The guy we purchased from (the guy who still holds a mortgage on the property) was a small business owner and his business went under. Now, he is filing Chapter 13 bankruptcy because of his business losses, but this only allows him to protect the house he personally lives in, despite the fact the mortgage on this property is good. His lawyer is telling us to just keep making the mortgage payments (directly to the mortgage company rather than thru him) and well be good because it’s not in default. The mortgage is thru GMAC, who we hear are not fun to work with. Are we going lose the house? Should we stop making payments? Scared sh*tless right now, we have three children, have invested a lot of money into the house on renovations (roughly K), and we recieved the K Home Buyers Tax Credit when we signed the contract. Feel like we’re in deep. HELP!!!

Does filing for bankruptcy affect what is owed in a judgment or to the IRS?

My mom is thinking about filing for bankruptcy since she’s up to her eyeballs in credit card debt, not to mention a debt that my dad incurred that he now owes money to the IRS and money on a judgment against them for a small business that failed a couple years ago. I don’t know all the details, but that’s the gist of it. So her question is whether or not the bankruptcy will affect what she owes on both the judgment and to the IRS? I guess getting rid of her credit cards will allow her to pay the judgment and IRS off quicker if they aren’t affected by bankruptcy, but she was just wondering because she is thinking about trying to file for bankruptcy on her own because she obviously can’t afford a lawyer.

Green Card through Marriage Fraud?

I know someone personally who has been in the US for around 9 years now and got married to an American for her green card.She’s waiting for her citizenship now, which she told me will get next year. The American man doesn’t even live with her, but she calls him to visit her whenever she decides…maybe knows the days/time the immgiration might check up on them…don’t know.
The woman also keeps that American guy in her office (working together though living separately) and always tells me that once she gets her citizenship she will kick him to the curb from work because he gets on her nerves. Now she’s dependent on him so can’t do anything about it. Number of people around her know that she entered into a fraud marriage, so definitely not a secret in her circle plus she lives with her son, thoough keeps fake albums of her ‘husband.’ Is it too late to report her as she’s waiting on her citizenship next year? The woman also sometimes on documents uses adifferent last name which she claims she will change into later on..but hasn’t officially changed it yet though keeps using it at the same time she uses her real birth last name. She also does what’s known ‘unauthorized practice of law’ when she deals with immigration just with her notary certificate and then gives the forms to a lawyer she works with to get the docs signed for her. As far as I know, only lawyers can fill out immigration forms, right? She also filed for bankruptcy years ago so the consulting office she has opened where she deals with the new immigrants who need help with paperwork and dont know shit about the country/laws, that office is under someone else’s name as she has no credit history herself now.
I also saw that one of her clients forgot to sign part of a doc, so she later asked her receptionist to sign it before sending the green card forms of that client off to the immigration. She also opened up a business within her small office where she supposedly find people for a marriage…as in a dating office, but the real intent in that is that she hooks up people for a marriage for a green card/paperwork. So do I have any chance in reporting this…and where exactly? I heard that many fraud marriages don’t even get reported on, so I’m kind of hesitant in reporting this knowing that her citizenship is in process now and that the authorities might not even do anything about it. What will they do exactly….? Just go to her place and check to see if her ‘husband’ is with her and that’s it?

The woman has hurt numerous people (newcomers not knowing the laws, including me minimaly though) and I feel like it’s a pay back time for all of her sins as she’s only exploits people. So any chance here????

dairy farm sold married business partners divorce should one be entitled to spousal support?

married almost 20 yrs, she disappeared with daughter (14) for 2 weeks with no contact left son (18) on farm. the husband offered her large cash settlement to leave farm
running she refused. farm sold his mom borrowed them the cash for the farm (basically like a bank) ex wanted the money but not to pay off the debts. her theroy is she should get money and he gets the debt.his mom received her money back and now his ex claims she wants spousal and she is going to claim bankruptcy on her share of the debts unless he takes all the debt.but as of now
he no longer has the farm or that type of cash flow to cover those debts on his own. but as stated they were business parteners she sold many items from the house and she kept the money.she walked away from the business and family (only taking the daughter) and has worked various jobs since she has left and now is claiming she is unable to work and he needs to pay for her living?this man has lost everything his dream his life his farm his daughter for 2 yrs his son, his ex would not let him have contact with his daughter.she is looking for someone to take care of her financially .so he has nothing now and is still 100,000.00 in debt and she wants him to take it all and pay her spousal but they were parnters half the debt should be hers and there should not be spousal. he pays for his daughter but why should he pay spousal when they were business partners and she wasn’t financailly dependent on him, as she stated she worked the farm.the 1st judge said he wanted farm to still run be smart (to ex wife) and make a deal(to ex husband).. the husband tried..should she be entitled to spousal support, she refused the offer, forced the sale of farm, has racked the debts up with interest due to not agreeing to releasing the money to pay the debts off, but they were business partners who jointly worked on the farm and jointly earned from the farm and jointly made the debts and loans? they are still going through court. her lawyer has given her terrible advice she should of taken the cash settlement and not forced the sale of the farm.. as her life would of still been easy.as of now the ex husband works for another farmer, and she works on an assembly line. in your opinion as i know there are courts for these issues.. in your opinoin would you think she should be entitled to spousal support?

Do I really need to hire a lawyer for divorce?

Here are the details of our divorce:

We have only been married three years. I own the house in my name only, which I bought six months before we got married.

We have no children.

She left me and abandoned me. She cheated on me. The state where I live is a no-fault divorce state. (Contrary to my username, I don’t live in California.)

We are nearly broke now. I have tons of credit card debt now as I tried to start a small business and haven’t had much income for a while now. The credit card debt was run up by both of us, as most of the debt is a result of not having enough income. About ,000 of the debt is hers from a previous credit card. About ,000 is from my business. There is a lot more credit card debt from both of us.

If things continue as they have been, I’ll wind up in bankruptcy and foreclosure in about a year. I recently went back to work full-time, and I am trying to make enough money to continue paying the mortgage every month.

If I hire an expensive attorney, I’ll wind up in bankruptcy from all of the attorney fees.

If we can keep things agreeable, then I think we might be able to file a cheap divorce and just get it over with.

I’m fine taking on the debt if I don’t have to short sale my home or foreclose on the home.

I found out recently that my wife was hiding some money in another bank account from a 401K from her old job. It was roughly 00. I never saw this money until we lost 0 in our tax return this year from paying taxes on it. My wife also ran up thousands of dollars in prescription drug bills and medical procedures she didn’t need.

Our finances are still joined right now with a joint bank account and one credit card.

While I think she should be stuck with some of the debt, I would rather just get it over with. She has nearly destroyed my life and almost completely destroyed our finances.

What do you think? Should I hire a lawyer and go after her, or just try to be amicable and get out as fast as I can? What liabilities may I be subjecting myself to if we try to do it cheap?
I’ve heard you can’t close a joint checking account if both people aren’t there together.

Can one owner of a car that the title reads "or" sell or trade it if the other owner is…?

…going to file bankruptcy soon.
My husband is going to buy a new car and is going to trade the car that has both our names on the title as "or". I have hired a lawyer to file bankruptcy for my business. My husband is not filing bankruptcy. Will this be considered fraud or what kind of problems will this cause if he trades this before the bankruptcy is started. When he buys a new car my name will not be on the title. Please let me know what to do. I will try to contact my lawyer next week to answer this but I will be crazy about this before then.

Can you legally prosecute someone for an unpaid loan?

….If they never signed a contract or any kind of written agreement?

My grandfather loaned his sister’s grandson, Zach,(my second cousin) a loan of twenty thousand dollars. He claimed he was going to better his life by taking flying lessons to become a pilot. He convinced my Papaw that this was basically a "education" loan. My grandfather, being the generous and giving person he is lent him the money and set up a payment plan with Zach to get the money back over time. This was in April of 2009. My Papaw was diagnosed with cancer in June 2009 and passed away in November 2009. Zach made payments until November 2009, when my Papaw passed away.

Before my Papaw passed, he told my aunt (which is over his estate) to make sure that Zach keeps making payments. Now Zach has become extremely disrespectful to our immediate family. He doesnt make any payments, he doesnt return calls or texts and he gloats and posts pictures of a new small business he has opened on Facebook. My aunt even met with him and lowered his payment so he would be able to pay.

So what I am wanting to know is, without having any written agreement between Zach and my grandfather, can we take him to court to get the money back?

Also another detail is today we ran into him at the bank and he said "I just filed bankruptcy, my lawyer should be in contact with you"

Can I get my money back from my Lawyer?

I gave my Lawyer a deposit for my personal and business bankruptcy its going on 16 months he got me a case number for my personal and then it was dismissed do to lack of filing income statements and a few other things. Is there anything I can do to get all my money back from him.

Seeking some one who has worked with the IRS in help with my tax problems, I turned partner in for sales tax fraud and audit was done but, I got the bill and now the IRS used my audit to increase the fee owed, I now am under appeal with more than ,000. owed I fled motions to take me off partnership fees owed but they are playing hard ball, my partner had thrown away requested documents that I had filed motions for and now partner has filed chapter 7 bankruptcy. So you see I need help I am pro-se [ with out a lawyer ] and need help, questions as follows for Pa.

1.Will bankruptcy erase sales tax and employee taxes?

2.As silent partner and whistle blower in this Irs case can I be excused from these fees due in this partnership?

3.The hard ball style used with IRS, If I go to hearing and state my case pro-se will I get releif?

4.Can the tax people as seen on tv really help, I called one company and was told for 00.00 they will reduce fees to ,000. Is this true?

how do get a title to a Mobile home?

i am filling for bankruptcy i have an old Mobile home that has never been in my name the place that i got it from has went out of business also there is no plates or numbers on the Mobile home. I don’t know the guys name that i got it from the lawyer is wanting me to get a title for it how am i to get one? The Mobile home also has no fuse box in it the wires are also gone out of it the floors are falling though i have told her this but she still wants a title.
i have looked every where on the mobile for the serial numbers and i can not find them. they have been renoved or something. Everbody that I have talked to needs the serial numbers but I do not have them and can not find them.

I owe a man who filed bankruptcy chapter 7 in Ohio and I recieved a letter saying to pay the lawyer not him. It says in the letter and I quote "The undersigned is the duly appointed and qualified Trustee in the above captioned proveeding under Chapter 7 of the Bankruptcy Code. As trustee I have legal title to all non-exempt assets of the Debotors in this case invluding any of their right to the balance uner a vertain installment sale of may 10th 2010, where you purchaed back from Mr. **** his interest in my company name. Then it says to send all payments to the lawyer.

My question in why am I sending him the money? Who is actually getting the money and what if I am looking to file bankruptcy? I am not looking to lose my business but now I am curious.

If you need more info just let me know I’m trying to be as specific as I can.

This year we went under on our home based business! We filed chapter 13 on September 15 2010! We filed on our credit cards and other non secured debt, but left our 1st and 2nd mortgages off! What I mean by off is that we would be paying directly to the lender and not through the trustee off the court! I thought that we were current with our first mortgage; I knew that we had gotten behind on the 2nd but caught up before filing chapter 13! To make a long story short I didn’t find out until I went online and checked our past bank statements that we were behind on the first mortgage! We are still current on the 2nd but the first is looking at foreclosure! We did receive mortgage modification forms sent to us by the mortgage company the other day! We didn’t ask for them they just them to us! My question is if the mortgage company decides to foreclose will this be grounds to have our chapter 13 dismissed?
@ Real, I have ask my lawyer and he didn’t think that this could be an issue! But I would just like some other knowledgeable people’s opinion on this!

Chapter 1~
Today was the day. The anniversary. The day things turned worse, but then after a long while, better. But on today you don’t remember the good things. You just think of what caused the bad. The Fight. It wasn’t like a normal fight between children and parents.
This one was different. We were going for each other’s limits. Trying to see how far we could push each other to see which one of us lost it first. I was the one who lost it.
It was a normal night for us my dad on the couch, drinking, and watching wrestling. He was totally out of it like normal. He was a lawyer, and a big man. He had a very broad shoulder, and really big hands. He was a gaping 6’7, and bulky. One his fat, tan, face there was a big grimace on it all the time, one that just ruined his face. His eyes were coal black, and seemed to go deeper with displeasure every time he saw me. My mother was also a business woman. She was a model. She was tall to, around 6’0. Tan, bright eyed, beautiful. Everyone saw her as the happiest woman alive, until she saw me. It wasn’t that she hated me, no that was not it. She well, just didn’t like me. Okay I give up, yes she does hate me. I have no idea what I did. We all had a wonderful relationship until I turned eight. Then it turned bad, for all of us. They had to be away more on business trips, and when they were home I wasn’t on their top priority list if you know what I mean.
So now six years later, we are practically strangers. Not that I mind because I am different now to. I have become something that is the total opposite of them. A complete 180 from what I used to be. I have died my hair from blond to now black, and have it layered. My attire consists of skinny jeans, converse, flannel shirts, tank tops, and t-shirts. I am now into bands. Like Escape the Fate, or Family Force Five.
I am what people now days would call emo.

It was now 11 at night, and I am not even considering going to bed. I am lying down on it, but not even close to sleeping. The night was almost over. I am still waiting for something bad to happen. Something always does. Last year I was beat, the year before I had to sleep outside on the hammock because they threw me out.
My room was small, confined. It had a twin bed on one wall, and a small dresser on the opposite wall. The one in the back had a window one it, since I am on the first floor, and the wall with the door on it had my good-for-nothing desk in front of it, with my computer on it
Nothing has happened yet. Everything today ran as smoothly as I hope every year. They completely ignored me. And I was so, very, thankful for that. But I know that my peacefulness isn’t going to last for long.
*knock knock*
And here it is. Well this isn’t going to be fun. Here is my father and mother, waltzing into the room, each with steel baseball bats in hand. They slowly walk towards me, with twisted smile on their faces.
My mother steps forward.
“Aaralyn dear, why have you locked yourself away all night it is quite rude.” She shakes a reproving finger at me, as if I have done something wrong.
I have nothing to say to them, but I know if I don’t, those bats won’t go to waste.
“Why, mother, I was just up here reading and doing my homework.” I reply in my sweetest voice.
My father steps forward, his gaze cold, all signs of a smile gone. “Aaralyn we know what you did there’s no point in denying us. You shall be punished.”
“What, WHAT, have I done to disobey you?”
They both step closer then, so close they are almost to the bed. My mother cold and precise says “You have told about our family, shared secretes that were never to be shared and for that you shall be punished”
I had no idea what they were talking about. WHAT secrets? I mean, if there talking about how they abuse me, I would never say something like that to anyone. So that’s what I tell them.
“I have absolutely no idea as to what you’re talking about.”
My father’s face turned livid. “Don’t you DARE LIE TO US!”
And that’s when the bat came down.
But amazingly I had reached up on my wall and grabbed my hockey stick that hangs there and swung first. I heard it connect with something, and looked up. It had stopped the bat. I then, instead of just lying there, got onto my knees and, while my parents were still in shock threw a blind-rage filled punch at my father. Again, and again I just kept hitting him. I had so much relief and satisfaction in just beating the crap out of him that I just hit him so hard he went flying back. And I followed him

Dear diary, today was awful, mum took me to see a lawyer, for some reason people think the old creep should know what happened. I disagree it’s my business. People say he could help. Help with what? Prove that I’m normal. Anyway here is what happened.

‘I’m afraid I can’t help you if you can’t tell me anything else’ said a very important looking man with a trench coat on, (if the matter didn’t matter so much to my mum I would have been calling him Paddington bear.)
‘Are you listening to Mr Saddler, Amy? This is very important; you need to be paying attention.’
‘Amy, can you tell me everything you remember?’ said Paddington
I kept my head down. I didn’t want to talk to him about “the incident.”
My mum then got into a bit of a fluster “Oh Amy when are you going to start helping yourself, your just getting yourself into a deeper hole, you childish girl” thankfully I had heard this speech before so I didn’t get to embarrassed.
Then the dreaded you need to go into a small corner and think about this, speech came.
‘Mrs Mont, I suggest if you want any help you tell your daughter to think very carefully over the events that happened, otherwise there is nothing I can do.’

Pointless isn’t it. After reading that you’re probably wondering why we were there in the first place. Well I’ll tell you something, you don’t know what’s going to happen in your life on your first birthday, so you’re just going to have to read on past the first chapter.

I have to go for dinner now, I’ll write later.

Where do I turn to for honest help with secured loan default and other debt issues?

Hi, I owned a business a few years ago and it went belly up. I was forced to close shop and was left with major debt to deal with. I settled some of my business credit cards, but my current situation is:
- I have a small business administration loan (SBA) for 0,000. They got a judgment against me and I’m trying to work out a payment arrangement with them
- I own four houses but they all have liens on them from the SBA
- I have 30-50k in credit card debt
- I owe k in taxes to uncle sam
- I owe about k in property taxes

So, all in all, everything is great. :) What I’m looking for is help on how to find a trustworthy person/company to work with to help me through my possible options, but bankruptcy to other measures. It’s so hard to find people online who aren’t trying to swindle you. Any help you can offer for finding the right people or even the right category of person would be greatly appreciated. Not sure whether I should be going to a lawyer or financial adviser or some combination.

What Can I do? My son called he has bills on his credit report with my husbands SS Number on them.?

We filed Chapter 7 in Sept 2009 it was final Dec 7 2009. Now our son and his family were trying to buy a house and found bills on his report on me with my husbands Social Security Number on them. He called me yesterday all Huffy. Asked how our bills showed up on his Social Security Number like I had any way of explaining this to him. I told him I did not know How they could be on his credit report.When he and his father have different Social Security Numbers.Big difference between 332 and 432 one born in 1958 one born in 1982 My husband is Paul Lee and our son is named after his father he is Paul Lee II. He gave me the number I called the business and they got nasty with me. It ended up being a screaming match before it was all over. I told them that we had filed bankruptcy and anything with MINE or My Husbands Social on then went in Bankruptcy. They told me HELL NO they did not that these were my bills they were on my husbands Social Security Number with me as patient and they were on my sons credit report since they could not get the money from us Our son would have to pay them Or else they would go to Collection But Someone was sending them the money. I told them they went with our bankruptcy. But she refused to hear what I was saying Everytime I opened my mouth to say anything the woman would cut me off. I called my lawyer who handled our Bankruptcy and he assured me that these went with the bankruptcy. Because we listed this Company Name on our Records as having bills with them and so they pull up any accounts with Mine and Hubby’s Social Security Number on them they do not look at names or any thing they go into their system and pull up the accounts with Number that match ours. And then they are deleted. But can someone tell me who to call to find out why this happened. Nobody can bother to explain to us how to fix this. Only Seious Responses to this please this is Hurting Our sons Credit.
Son is not Junior he is the 2nd. But I think some of the problem is he refuses to use the 2nd after his name. And at different times in their marriage they have lived at our address and or expected me to take their kids to the Doctor or Hospital because they are to Lazy to tend their own business. But my lawyer said it goes on Social Security not name anyway. So I have no explanation for my son
I was on the phone call with my son yesterday they told him to hae me call them about the bills so I did they dialed him back and told me I had to take care of the fowl up. Because they were my bills. The lady was giving out my husbands social securtity number like it was candy. My son told her it was nothis number. She told us both tough crap basically it was there we filed Bankruprcty so pay it. Or it would not be removed.
