advice on foreclosure?

For lack of a better term i was forced to take out a mortgage last year on my home that was paid for. The terms and percentages were awful but thats besides the point.

My income at the time was sufficent to pay my bills and the mortgage.

I ran a successful business for a little over two years until 4 months ago when things went downhill. My mortgage payment is more than most people make in my area in 2-3 paychecks and now im unemployed with a SMALL list of other monthly bills besides the mortgage. I do have about k in other unsecured debt from the business and other unsecured creditors from when i was young that i never took care of.

I have thought about bankruptcy, chapter 13 is a no-go mostly because i cant afford the mortgage payments now so why would i waste my time with a 13?Otherwise it could work,but otherwise i dont really need a bankruptcy if were not including the house mortgage because i could just set up monthly payments with my creditors at a small payment.

my monthly expenses are slim so im not worried about that.

My problem seems to stem from my home, i have about 40k worth of equity in a 117k home.

With that kind of equity, it really does not make sense to file a chapter 7 because in my state you lose all equity besides 5k no matter what.

It really doesnt make sense to do a 13 because as already stated i cant afford the payments now,much less the payments to all my creditors plus the mortgage.

And the only other options are selling, of which is not really an option because foreclosure has already been initiated.

Or a deed in lieu of foreclosure, but then im giving them all of my equity for "free" although the foreclosure would likely not show up on my credit report and i could begin to repair the other damage.It would be faster to do this than to wait 10 years for a BK to come off the credit or 7 years for a foreclosure to come off.

OR just let it be foreclosed on……thats not appealing at all ofcourse.

Can someone keep work equipment in a chapter 7 bankruptcy in the state of New York?

There is a utility trailer and some lawn equipment that is needed to keep the business going, would that be liquidated in chapter 7 or is work equipment safe? Chapter 13 plan is no longer feasible and there is consideration to convert to 7 but the work equipment must be preserved. Please let me know specific to New York State, because NY is always "different".

My husband is being sued for a credit card we took out for business in 1991.?

We had started our business in 1987. It failed in 1994. Bankruptcy followed by Chapter 7 in 5 years. The card was sold to another company which contacted me in 1999 and I started paying them what they asked until 2002 when my husband had to go on disability. Five months he had to wait, of course, for his first check. Our income fell to my 3 figure disability check and we couldn’t pay most of our bills and I did quit making those payments on the advice of Credit Counselling with United Way. The original card is 11 years old, but it was sold. How can I be sued for this amount, which has grown to over ,000 including interest and other charges added on?

Does the republican crackdown on bankruptcy laws in 2005 prove they are against poor and for rich?

Only poor person files bankruptcy. And only large banks and credit card companies (which are rich) oppose bankruptcy. Whether a person is financially responsible or financially irresponsible, the government has NO business telling citizens how to spend. This is free country. We don’t want government interference in our lives. Republicans don’t preach their own mantra. This bankruptcy crackdown interferes into the lives of the lowest man of the ladder. Furthermore these bankruptcy laws don’t prevent people from filing bankruptcy. The bankruptcy lawyer industry is equally very large and they have all figured out numerous ways to get around tighter 2005 laws, which in effect defeated Bush efforts to make it harder. This is evident by the fact that 1.5 million filed chapter 7 last year, compared to less than a million prior to 2005 laws.

Statue of limitations on sales tax? (TN)?

I am trying to help my mom out with this one…. Several years back she owned a c-store with a now ex friend. When the business closed, there were unpaid sales tax…. The partner filed a chapter 7 before the IRS came after them, Turned out they only went after my mom even though all papers were in both names. She is now in a chp 13 for this and has been paying 0 a month to the bankruptcy to pay this. Now they say she isn’t paying enough (she makes hr now) and want to dismiss her case. Is there a statue of limitations on this and why aren’t they holding ex-partner responsible for all of this? She has crappy atty, and she has called around to other atty’s but they tell her it is a conflict of interest for them to talk to her… What to do? Please and Thank you
To the person who said she is lucky to not be in jail: They were paying the sales tax when the business was open. She left the business before it closed and the taxes due were from the date after she had left. She has been paying the taxes back ever since! SHE did not commit fraud as she wasn’t even in the store and had already turned over keys and had consulted an atty to dissolve the partnership. I think she has been a great person for paying this bill when she wasn’t apart of making it

I will make a prediction. WWE, Inc. (owned by majority shareholder Vince K. McMahon) will file for Chapter 7 (Liquidation not 11 Reorganization) in 2 or 3 years! My premises:

1. This Youth Movement
2. WWE, Inc. is out of goals and ideas
3. Not a good business plan
4. Vince is the chairman
I never mentioned Del Rio. I could care less that he won the RR!

Lawsuit Filed Against Me…Now what?

About a week ago I got a business card from the county Deputy Marshall on my door. I called back and left a message but got no response. A few days after this I started receiving random letters from cracker-jack law firms saying a lawsuit had been filed against me in my county and offering to represent me or help me file chapter 7 or 13 bankruptcy.

I went to the courthouse and couldn’t find anything filed on me there at all so I was confused. Yesterday I got another letter from a lawfirm offering the same services as the others, but it listed a case number. The collection agency(I assume) filed it and miss spelled my last name which is why I could not find anything before.

So my question is this. The lawsuit has been filed, but I have not been served yet. Suit was filed on June 1st and it is the 11th but I have not received a notice yet. Can they proceed with anything in court if I haven’t been served? I am still trying to research it but the collection agency suing me does not show up anywhere on my credit report I just pulled yesterday and any accounts I had in collections are from back in 2004 and have been charged off.

Also if they miss spelled my name on the lawsuit can I get it dismissed and make them re-file it? I’m hoping that I can settle this before it goes to court, but I just don’t want them to do something in court w/o me knowing if I haven’t been served the official notice of the lawsuit yet.
Just some other info. I don’t need to file bankruptcy, any debt they would be coming after me for wouldn’t be anything more than 0 at least according to what is on my credit report. I want to settle it, I just want to make sure they can’t pass any judgements on me in court if I haven’t been officially notified by being served the papers. Oh and state is GA in case that has anything to do with the filing and serving laws.

How can I keep them from taking my Social Security for school loans?

I am 61 1/2. For health reasons, I was planning on retiring at age 62. However, I just received a letter from a debt collection agency telling me they will take ALL my Social Security monthly payment to pay this debt. I need every penny of that money.

I graduated at age 42 in December 1992 from ASU with a Bachelors of Science in Business Management, which has been a totally useless as far as getting paid better or finding better job placement. However, I greatly appreciate my education and I really enjoyed the time I spent at Phoenix College and ASU, but times have been difficult and it doesn’t look like they’re going to get better anytime soon. I would happily repay the money if I could.

I was fully disabled for two and 1/2 years in 95-96. I went back to work, but lost my job in the last economic downturn (approx 2003). It took me another four years of working low paying jobs through various temporary placement services to secure another full time position with the State of Oregon. I am also severely hearing impaired, which further limits my ability to get a job.

I have been partially disabled from a fall in March and I have had three operations on my back in the last three months. I will be able to return to work in November part time and my doctor doesn’t think I’ll be able to work full time until January 2009. My 62nd birthday is on March 31, 2009 and these health difficulties are the reason I really need to retire then if I possibly can.

I there some way I can claim disability as a reason to have the loans forgiven?

Also, I have enough medical debt to claim a Chapter 7, I think. Last I heard, these loans could not be put in either Chapter 7 or 13. Is that still true?

Possibly Getting Sued by Creditor, what are my options?

I have not received an official notice from a creditor or the court, but I got several letters in the mail from cracker-jack legal services saying a lawsuit had been filed in my county against me and they offer Chapter 7 and 13 services to get me out of it.

I did have a business card left on my door from the county Marshall but did not say in what it is in regards to and I was served no official papers. I have not received any official papers/documents or notice from the creditor or the court about a lawsuit and there are no court records on file right now for me at the county courthouse, I checked yesterday after getting the card from the Marshall.

If I am being sued, I have to get an official notice from the court first, correct? If so, once I get that notice, do I have options to settle with the creditor before it goes to court? I really am not sure what it is even for as the only cards I have that went to collections were paid off or charged off years ago.

Would you trust a NON-CERTIFIED petition preparer to handle your bankruptcy?

I am a new paralegal and a couple of my friends and I are looking into starting our own business preparing chapter 7 and chapter 13 bankruptcy petitions for debtors. We are well trained in preparing petition forms and are excited to get started. Legally you do not have to be certified to prepare bankruptcy petitions. Infact you do not even have to be a paralegal or an attorney. Certification can be a little pricy and often has yearly/bi-yearly fees to retain certification. It is defintely something I plan on investing in at one point soon but we are unsure if we should even start our business without certification because of the lack of credibility, and ultimately trust we would have from potential clients. Would you personally trust a non-attorney who is not certified to handle your bankruptcy? Have you or anyone you know had an experience with one?

What Can I do? My son called he has bills on his credit report with my husbands SS Number on them.?

We filed Chapter 7 in Sept 2009 it was final Dec 7 2009. Now our son and his family were trying to buy a house and found bills on his report on me with my husbands Social Security Number on them. He called me yesterday all Huffy. Asked how our bills showed up on his Social Security Number like I had any way of explaining this to him. I told him I did not know How they could be on his credit report.When he and his father have different Social Security Numbers.Big difference between 332 and 432 one born in 1958 one born in 1982 My husband is Paul Lee and our son is named after his father he is Paul Lee II. He gave me the number I called the business and they got nasty with me. It ended up being a screaming match before it was all over. I told them that we had filed bankruptcy and anything with MINE or My Husbands Social on then went in Bankruptcy. They told me HELL NO they did not that these were my bills they were on my husbands Social Security Number with me as patient and they were on my sons credit report since they could not get the money from us Our son would have to pay them Or else they would go to Collection But Someone was sending them the money. I told them they went with our bankruptcy. But she refused to hear what I was saying Everytime I opened my mouth to say anything the woman would cut me off. I called my lawyer who handled our Bankruptcy and he assured me that these went with the bankruptcy. Because we listed this Company Name on our Records as having bills with them and so they pull up any accounts with Mine and Hubby’s Social Security Number on them they do not look at names or any thing they go into their system and pull up the accounts with Number that match ours. And then they are deleted. But can someone tell me who to call to find out why this happened. Nobody can bother to explain to us how to fix this. Only Seious Responses to this please this is Hurting Our sons Credit.
Son is not Junior he is the 2nd. But I think some of the problem is he refuses to use the 2nd after his name. And at different times in their marriage they have lived at our address and or expected me to take their kids to the Doctor or Hospital because they are to Lazy to tend their own business. But my lawyer said it goes on Social Security not name anyway. So I have no explanation for my son
I was on the phone call with my son yesterday they told him to hae me call them about the bills so I did they dialed him back and told me I had to take care of the fowl up. Because they were my bills. The lady was giving out my husbands social securtity number like it was candy. My son told her it was nothis number. She told us both tough crap basically it was there we filed Bankruprcty so pay it. Or it would not be removed.

Ch. 13 bankruptcy Disposable Income?

I do not have the option of filing a chapter 7 ( I claimed some 5 years ago), my wife lost her business upon becoming disabled from a horrible accident and she made the bulk of our income… which cut our income to a fraction of what we were at. I need some relief. I am worried with our income and general bills the trustee with say we do not have any disposable income. Does any one know what happens?
If the trustee says we do not have disposable income do we have any other options? I cannot afford to be garnished we are barely making it as is do I have any options out there at all?

I'm stuck on this problem and can't find the store and office supply totals nor the capital?

Can any one help?

Just started a business and may already be going under…what happens to our home, finances?

So here is the story. we signed a lease for 3 years for a store that already had some inventory and the buildout done. We were upfront and said we had little finance options. so to pay them for the good and buildout we had to pay a certain amount each of the 3 years. we used what little money we had to purchase some store items and more inventory. We were told their sign guy would work with us and work out a deal where we would be able to pay the sign guy a certain monthly amount. turns out this is false! we can not make rent because no one knows we exist without a sign. we cant get a loan for it, and for some reason he is blocking the sale of the store to anyone else. This makes no sense to me as if someone else buys the store and can pay him his money why would he say no to that? So at this point if he dont let us sell we will be forced to just leave the store and be screwed. So my question, then what are our options? I get we would be forced to pay that contract, but it aint gonna happen, no money for it. That being said would we have to file chapter 7, or 13, or is there a way to get rid of that debt without doing that. whats the difference between 7 and 13. Also, would we lose our home or cars since we dont actually own them we are just paying on them?
Glenn- its not an LLC , its under my name and wifes. he hasnt tried selling his self. he has just said i can not sell because the agreement on the contract was with us. even though he told me before signing i could sell as long as they approved the buyer. this is another frustrating point. what happens if he wont let me sell and he doesnt sell the property? am i then entitled to pay? and if he does sell the property but after im evicited, do i still have to pay? if so can there be options for me to get out.

Where would I go to receive an honest advice on my tough financial situation and debts.?

I’m a RE agent and the only one at the family who works however I have not been making any money for 6 months! All my 4 children and my wife are students. We have been living a good life with a family of six since. We own three properties including my home. My efforts to sell any of my properties including home has not been successful. We have been using our credit cards and have max them all. As a result of this situation I am not able to refinance or obtain any other loans.
As a business person, I have started to set up another business which I can replace with my current career. It may take at lease six months to make money.
I have other valuable items that may bring me money if I sell them but those also take time.
The situation has kind of depressed me. What should I do in this situation? I spoke to a lawyer about filling chapter 13, but it looks like most lawyers like chapter 7 better. I know I can get back to my feet if I would have enough time to reestablish. please help!
