How can I request funds back from a company that went out of business?
I paid ,200.00 to a bankruptcy company in 2004 and did not finish the filing process and they said I would have that credit with them when/if I was ready to complete the process.
Well now I’m looking into it again, but was told that particular company "went out of business." I talked to the same attorney, but he did not offer me direction about how to get that credit back.
There must be a way I can petition for those funds back. Nothing in my paperwork mentions that I waived anything in this occurance. Please don’t tell me I need to hire another attorney to do this! Can’t I file something with the County or State or something?
There is an issue of timeliness here. If the company went bankrupt under Chapter 7, you have an unsecured claim which needed to be filed with the court before the bar date (which has probably long since passed). You may be able to get more germane information out of a lawyer, but a lawyer’s bills will outstrip any proceeds from your claim. You may also check with the Secretary of State of your state, to see what the current condition of the company is — and who accepts service on their behalf. Bottom line: you’re probably out of luck.
It’s only worth filing if they have assets . . . corporations do not have personal liability.
If they filed bankruptcy you might have rights as an unsecured creditor; check with the district bankruptcy court. IF they just went belly up, lots of creditors didn’t get paid. INcluding you.
TRy your state’s incorporation comission; maybe thru the Secretary of State’s office
