Legal Question: RE: Chapter 7 Bankruptcies?

I’m about to start a Chapter 7 bankruptcy petition preparing business and I needed to find out a few different things before I get bonded and registered with the county clerk’s office next week.

1) Since a legal document assistant like myself can not delegate legal advice, would a prospective client/debtor have to find out if he/she qualifies for Chapter 7 BEFORE coming to me to fill out the client questionnaire and have me fill out the petition, schedules, etc.? If so, do they need to go through an attorney to do so, or will they be able to tell based off of their existing real and personal property, income and debts?

2) What type of affordable Chapter 7 Bankruptcy software is available to non-lawyers (legal document assistants like myself)?

I am aware of the limitations placed on legal document assistants (fee caps, inability to delegate legal advice). I only need to determine the two aforementioned pieces of information and then I will be able to start work asap.

what does an offer in compromise to the small business administration mean?

I have come across some information within my company in which I overheard our company owner speaking to a bankruptcy attorney rgarding an offer in compromise.

What happens after the SBA accecpts an offer in compromise? does this just mean my owner doesnt have to pay this debt and can no try to secure other loans or does this generally mean the doors are closing shortly after?

I already have a few employment offers elsewhere so dont worry about me. There is just a buch of silence from management in the office and im trying to get to the bottom of it.

Can one owner of a car that the title reads "or" sell or trade it if the other owner is…?

…going to file bankruptcy soon.
My husband is going to buy a new car and is going to trade the car that has both our names on the title as "or". I have hired a lawyer to file bankruptcy for my business. My husband is not filing bankruptcy. Will this be considered fraud or what kind of problems will this cause if he trades this before the bankruptcy is started. When he buys a new car my name will not be on the title. Please let me know what to do. I will try to contact my lawyer next week to answer this but I will be crazy about this before then.

After 8 long and utterly painful years, the nightmare of divorce continues and has led to my complete financial ruin, irreparable harm to my career and most important, I’ve been deprived of any semblance of a relationship with my children. I readily admit I contributed to the demise of the marriage however my ex-wife has used every tool at her disposal to squeeze every drop of blood from the stone and that includes her own children. Over and over again, she would manufacture a crisis accusing me of everything untrue from abuse to drug addiction and then move the kids in the middle because she knew my love for them was enough that I would capitulate to her to save the kids. Most notable was her coercing my then 14 year old twin sons to aide her in burglarizing my apartment and stealing the last ,000 of assets I owned. Six months later, charged with 5 felonies I thought finally she would be held accountable for her terrible deeds however the prosecutor informed me that my children were prepared to overturn their previous testimony and state that they acted alone. The prosecutor asked if I’d take a deal to save my children from lying in court. I asked for only my property to be returned. My ex-wife refused ANY deal and once again I rolled over to protect my boys.

Divorced the same month in December of 2006, I lost my job as senior technologist for the business. My divorce required me to pay 40/mo in combined support. My ex-wife declared I was voluntarily unemployed and a labor lawyer said that it would be difficult and costly to fight. I was unemployed and the terms of divorce left me nothing therefore I was in desperate financial shape. I then learned that the VA Dept. of Child Support Enforcement can modify support. I called many times. I wrote letters. I received no response. Soon my bank accounts were seized for back support forcing me to be evicted. I was forced to move in with my parents. 49 years old and living with mommy and daddy. Humiliating.

Finally I got a good job in CA but it too lasted on 6 months since the economy caused the company to shutdown the division I was hired into. The day I was let go, I again called the VA DCSE and after several tries finally spoke with the case worker who told me what to do to modify support. I complied and I waited as I again lived with my parents to try to recover my life. After 9 months (last December) in the eleventh hour of the process when I fully expected to have my support finally modified by the court, I was informed by the case worker that she transferred my case to PA (current state of residence) and therefore my review process was terminated. Incredible! Unbelievable! Since had the support been modified properly it would have been retroactive to the date my ex-wife was served (March) therefore the transfer cost me 40/mo for every month since March of last year. In February I marched into the DCSE office and demanded I speak with a manager which I did. He was shocked at what happened and I felt I finally had a sympathetic ear. He told me what to do in court since I can’t afford an attorney. I have been trying hard to navigate the legal system that is hopelessly biased against me.

This week I went to a hearing to temporarily modify support in advance of the hearing on the entire petition scheduled for September. I was shocked when the DCSE lawyer requested a trial and clearly was gearing up to fight me. The DCSE’s abject failure to process my reviews and requests for support, first in 2007 when they simply ignored me, and then in 2009 when they transferred my case. The DCSE has done everything to PREVENT me from supporting my children.

Today my credit is impugned with a Child Support Lien of over ,000 as well as bankruptcy that occurred finally in 2008. Since credit scores are used today as a filter on new applications I can’t get a job at the gas station (I tried!). Maybe bagging groceries or other parolee oriented positions.

The damage to me is almost incalculable. I am a former executive office of public companies and today i can’t get a job at a gas station due to abysmal credit. I’ve been unemployed 2.5 of the last 3 years and will never aspire to the same level where I was a 6-figure wage earner since 1989 and former gazillionaire with stock prior to the 2002 crash. I have a new wife who remains in Europe waiting for me to solve the problems so we could be reunited. My ex-wife continues to withhold my court ordered custody. And she gets away with everything because the entire system is so bloody biased against me. I paid and paid and paid for the sake of my children and now the system is a willing accomplice to her campaign of destruction.

Our constitution guarantees us the fundamental rights of life liberty and the pursuit of happiness and that these rights cannot be deprived without due process. Where was my due process?!? My life is in shambles and pursuit of happiness impossible.

CPAs and Attorneys: Law degree vs MBA?

I am a CPA with 3 years of experience in tax preparation. I am trying to plan my future and career. Any other CPAs / lawyers that can help share opinions or their stories please help.

I do not know if I want to eventually open my own tax service, or somehow narrow my focus to large companies and/or transactions. With this approach I would not be stuck in the "corporate world" and "office politics". I would work hard but reap all of the results. – I guess I could do tax or go to law school and be an estate/trust attorney, or bankruptcy, business formations, something to leverage my accounting background.

On another note, maybe I should head for the industry and work toward executive level opportunities in the future.

Any input is appreciated. I’m still not sure what it takes to reach the goal I decide or what to expect.

Former employees of a shuttered California auto plant sued the factory and Toyota Motor Corp. on Wednesday, claiming they were denied fair severance packages because injuries kept them off the job in the months leading to the facility’s closure.

The suit, filed Wednesday in U.S. District Court in Oakland, seeks a revised severance agreement, restitution, lost compensation, other employee benefits and monetary damages.

The lawsuit also seeks class-action status. Lawyers claim that about 300 of the 4,700 employees who lost their jobs when the Fremont-based New United Motor Manufacturing Inc., or Nummi, closed April 1 may be affected.

Many of the laid-off employees, who assembled Toyota cars and trucks. Employees who worked continuously in the six months before the plant’s closure also received enhancements based on years of service and other factors.

Tony Lawson, a lawyer for the plaintiffs, said the enhancements added an average of ,000 to an employee’s severance agreement, so denying those who were on disability leave during that six-month period translated to a huge loss for the worker.

"Some of these people had worked there 25 years and were injured in the last six months," Lawson said. "We allege they’re being discriminated against with respect to their severance because of their disability."

The lawsuit also claims that disabled workers were not allowed to take advantage of some employment services such as career and skills assessments, and they were refused employment when they attempted to go back to work after a doctor said it was OK.

Nummi spokesman Lance Tomasu said the company doesn’t typically comment on pending litigation, however, the factory "has always prided itself on treating its team members with respect and fairness and we believe we’ve done so in this situation."

Toyota spokesman Rick Hesterberg did not immediately return a message seeking comment.

The Nummi plant was established in 1984 as a joint venture between General Motors Co. and Toyota. GM made the Pontiac Vibe there but withdrew from the alliance last year after filing for bankruptcy protection.

Toyota made the Corolla sedan and Tacoma pickup at the plant but said it could not sustain the factory without GM and warned Nummi it would shutter operations.

Besides the jobs lost at the factory, the closure devastated thousands of others whose businesses were made servicing and supplying the plant and its workers. Nearly 8 million vehicles were built at the sprawling facility at the southern edge of San Francisco Bay before it closed.

New hope has been injected in the area with two recent announcements, however.

Tesla Motors Inc. said it was purchasing the plant to build its Model S electric sedan and collaborate with Toyota on an electric vehicle that will combine a high-volume Toyota vehicle with a Tesla electric powertrain.

The federal government also said it would provide million in emergency grants to help workers who lost their jobs when Nummi closed.

Would this have been so easy to do if they were in a Union?

How to defend myself in a Civil Suite when I'm broke!?

I had a civil complaint filed against me and my partner a while back. I retained a lawyer for ,000 but when the bill arrived from the following month for another ,000 I was pretty much in over my head. Economy was going down, bills rising, customers cutting spending, etc.

So I told the law firm I was broke and probably going to file bankruptcy. He said that would "stay" the suit and he quickly moved to be dismissed with the court as my attorney… since I could no longer pay.

I got a letter that said I had to respond in 30 days to proceed pro se, but I misread it and thought it said they would consider me pro se if I didn’t hire a lawyer in 30 days. So I basically defaulted on the suit. That was last October.

Now it looks like I may not need to file bankruptcy. We cut expenses, got food stamps, medicaid and I am working my way back up slowly but surely.

This lawsuit is meritless. It was a client who wanted to return k of computer equipment 3 months after purchase because he want out of business. He is a former attorney and is just trying to cause us pain. I can’t afford to fight it. I cant afford even a consultant.

I am not sure what I should do as my former partner has a lawyer and they want me to give depositions, etc to help him.

What should I do???

I have a question regarding the first time home buyers tax credit?

I had a contract on a house that was put in back in March 2010 it was a short sale and I waited two months for Wells Fargo to reply to the offer, before they could reply however, the seller decides that he doesn’t want to sell the house after all, his lawyer had advised him to file bankruptcy instead. Will the fact that I had a contract in before the deadline on the $ 8.000.00 carry over to new property that I decide to buy, or am I just out of luck due to this persons disconcerting way of doing business? Since I wasn’t the one that backed out of the contract, shouldn’t I still get the benefit of the incentive on my new property?

-we got a lawer to handle the case.
-he got her going to a chiropractor
-she was seen by an orthopedic surgeon and he found she had a torn miniscus
-she wasnt on my car insurance because she doesnt drive, although she has a driver license for identification purposes.
-the lady that hit her’s insurance was geico and the we requested them to tender policy limits…which are ,000
-they approved it and the release was executed.
-the hospital bill one night came out to ,000
-the 10 min visit to the orthopedic was ,500.00
-the therapy for 3 1/2 mo was about ,000
-MRIs are about another 00
-and the lawer fee ,333.33
-my insurance paid about ,000
-unfortunately we do not have health insurance.
-if we go after the lady that hit her, her only asset is a house that costs about 0,000 in the market right now. The lawyer suggested not to because the lady could just file for bankruptcy…she recently had forclosure on her home.
I feel were getting ripped off.
-I want to know what can be done so my wife is not in dept and her credit doesnt get destroyed…I feel our lawyer could care less what happens to us, he just wants his 1/3. the check for 10,000 came in from geico and he had us come in to sign it. He says he is going to try to negociate the amount that we owe from the different parties . we going to probably end up with less than 00. This has really affected our marriage because not only is she still in pain she lost her job but we are going to be in more dept than we already are. She didnt choose to get hit by that car riding her bike on the sidewalk. how much control does the lawer have of our money after he deposits it? once the check clears "7-10 business days" we have to come back and sign this paper stating what is owed… Does he get total control of our money? Say, can he still pay off his medical buddies without our authorization? I dont care about his part. I will pay him with no problem… What gets me is paying his medical people which he recomended to us…the chiro just touched her back less than a minute and they would just put heat pads and electricity. they never really did physical therapy massaging or anything. What did we get out of our misfortune? That for doing the right thing after an accident, getting an attornery. He just played the cards for the insurance to pay, then for him to pay off himself and his recommended medical specialists and we get hardly no compensation for the pain my wife still suffers after accident and our lost wages? This is crazy. What can be done at this point? I would not want to work with this lawyer again because on several occasions he was nasty to me over the phone telling me my "case just sucks", and scolding me ‘how could i not have health insurance for my wife?" I told him i dont even have it myself and neither do 47million americans.

in 2004 i bought a house and had it put on 2 acres of land that i owned out right for over 15 years, in 2008 the house burned down and was considered a total loss by the fire dept and the insurance adjuster, i sent the insurance proceeds to the mortgage company who has done nothing but give me the run around bouncing me from one dept to another, after nearly 18 months the mortgage company went to court and foreclosed on the property then 4 months later went back to court and had the foreclosure sale set aside, i have asked the mortgage holder to send me a statement of the total amount owed on the loan but they wont send me any thing in writing, when i asked for a statement saying they received the insurance proceeds they told me to write a letter requesting the information so their LEGAL DEPT could review it and decide if they could release the information to me. i had replacement insurance but would not rebuild because of the shitty way this company has done business with me. i have filed a complaint with the better business bureau the banking commissioner and the insurance commissioner in my state. we all know the banks do WTF they want to do without restraint that’s why our economy is so F$$$$D up, i don’t have the money to hire an attorney as it has taken all my every thing to try and put my life back together, i lost my job in december and im really struggling to get by with my son. Im beginning to get very depressed and would like to put this behind me so that i can move on with my life. if there is any one out there that can help me i would appreciate it and will pay you what i can. the attorneys that i have tried to talk to want hundreds of dollars just to talk to me then want thousands to help me. i tried filing bankruptcy but was told i needed the financial info concerning the mortgage the total on the loan was 90988 when the house burned down the insurance proceeds were 75000, but now with all the legal fees late fees and other bullshit i have no idea how much it is. i just know its a mess and all i do is cry, is there any one that can help me please!!!!!!!!!!!!!!!!!!!!!!!

i owe wells fargo for a personal AND business credit card. total about 20k. (was expecting 40k that i overpaid on my taxes that i’m not getting…blah, blah). anyways, i offered to pay them whatever i could and they told me not to even bother unless i was going to make the minimum payment (which i can’t afford right now). they said when it reaches 90 days overdue that they will either send me to 3rd party collections or take me to court. my questions:

1. which do you think they will do?
2. should i even bother paying what i can a month or listen to them and not pay anything?
3. they say that after 90 days it will affect my business credit. isn’t my business credit already screwed? if i pay them at least something will it still affect my business credit? will it stop them from sending me to court or collections?

i’m not going to declare bankruptcy (already spoke with lawyer)
i’m hoping things will pick up business wise soon and i can start repaying my debt.

i also have 3 other credit cards i owe on and an office lease i got out of. total debt about 75k. they won’t work with me either, i already asked them. thanks.
also they call me about 30 times a day and even after i call them and tell them i can’t pay the calls from them continue. they will call me 5 minutes after i spoke with them. can they do that? they also call my brother in law (don’t know how they got his number cause he has a different last name) and my mother and father multiple times a day and harrass them.

returning key to Franchisor?

Hello,
We own a franchisee. However we are so much in debt now we are forced to file for bankruptcy. We are filing personal bankruptcy because the business debt is personally guaranteed and we also borrowed from our personal cards to put in the business.
the Franchisor is the sub-leaser of the place. We are behind two months on the lease and owe the Franchisor royalties. Now we have closed the shop and the franchisor wants the keys back, because the lease is under their name and because of the owed royalties.
we removed all assets that we could physically remove.

They told my lawyer that they know I don’t have any money to pay so they’re not even going to sign an agreement that I am transfering the business over to them.
they said they’re going to go to court and ask the judge to have me give them the keys.
I will give it to them but I want to be sure they’re going to be able to do anything else to us. we don’t have any choice and we have no money. they have the upper hand now.
What are they able to do to us? and after I hand over the keys can I just dissolve the corporation

also when filing for personal bankruptcy does my corporation automatically fall under that? does it get dissolved?

please help!

How does business foreclosure affect a lien?

My wife’s family borrowed over 0,000 to help out with their farm. It was against my better judgement to loan them this money, but it’s too late now. So they took this money, essentially wasted it and now they’re more or less going to lose the farm. They’re trying to sell it, but it looks like it’s too late for that.

Last month, the bank refused to renew their commercial loan and it looks like they’re about to foreclose.

Am I basically S.O.L. now? Or do I still have a chance to put a lien against the property to get my money back?

I have a feeling that if I want to get my money, or at least some of it, they have to file for bankruptcy first. But isn’t it too late for that?

I’m looking at talking to a lawyer, but I’d just like some idea of how this works. I don’t want to spend the money and then have the guy tell me there’s nothing I can do.

How do apparently succesful buisnesses get into chapter 11 bankruptcy?

I just Found out the Flying J truck stops corporation is in chapter 11 bankruptcy. My question is this. Freakin HOW ? Every flying J truck stop I have ever been to has been busy . Really busy. And their prices are High compared to a neighborhood convenience store. And they get their money too because truckers HAVE to go to truckstops. I will get an energy Drink, a crappy burger and some potato wedges and be out 12-13 bucks easy. Not to mention the 500bucks in fuel my company just bought from them.

When some businesses like the restaurant down the street go under it makes sense because, hardly anyone eats there. But several times I have seen successful businesses like the PUMPHANDLE convenience stores go under

How do these businesses that have tons of customers and make tons of money manage to blow it ? Are they paying some Fat*ssed vice president of the company too much money to play golf on his 3 hour work day? Or are lawyers getting it from law suits ?

does my ex need to be notified that I am filing bankruptcy?

I live in michigan and have filed bankruptcy. Due to my employer closing some locations i lost my job about 5 months ago, with that i lost my health insurance. I had a major medical emergency that came up and have hospital/doctor bills totaling about ,000, so I was left with no other choice. I have a daughter and have 50/50 custody w/ her mother. We were never married, never had any joint accounts together, no house together etc etc. I pay a month child support and am currently overpaid on my child support by over 0 due to a "computer glitch" as friend of the court calls it. I know child support does not get put into bankruptcy. My lawyer called me today and said he was finalizing everything and that he needed my ex’s address because he has to notify her that I filed bankruptcy. I questioned as to why she had to be notified and he said he was doing it just to be on the safe side. on the safe side of WHAT?? as I stated, we had nothing together and this bankruptcy has nothing to do with her. Why would she have to be notified?? I do not want her to know that i am doing this and its none of her business of whats going on in my life. Is it a law in michigan that she has to be notified or if i do provide her address to the lawyer can i request that no information be given to her??

any info or answers on this are appreciated!

My father-in-law bought the business that he worked at when his boss retired several years ago. It’s now come to light that the owner (and the business) owes more than 20k to the IRS in backed taxes, and its threatening the business to the point of bankruptcy. Clearly, that’s an issue, but what help is there for business owners who inherit such a debt and don’t want to close?

And they’ve already got a lawyer…if that helps.

How can I (US citizen) and my fiance (Mexican Citizen) move (permanently) to Canada?

Basics of the story: I live in Oregon, my fiancé lives in Acapulco. The US is NOT helping us start our life out together. We want to move to Canada, ASAP, permanently. We’ve looked in to the country, and feel it is an incredible place to build a life. We are ready to move there, today.
There are some issues which are making our lives difficult. As with most issues, some are our past errors in life, and some are purely situational. We are two humans, trying to make a life together. We are not perfect. We have made errors. But we both feel we have finally found eachother, and there in, a reason to Try in life. We just want to live. Together. Somewhere we can both be legal, respected, equal citizens.

Here are the negative issues which should be taken into consideration:
-Neither of us have a substantial amount of money
-I have a k tax lien w/ the US gov (due to my parents, LONG STORY. I can file Bankruptcy to get rid of this, if it will help our case.)
-My fiancé was deported from the US.
-He has a “menace threat” on the records from CA
-He is not fluent in English nor French
-He has not completed the “Matricula Conusular”, I believe that is the equivalent of not finishing High School.

Here are the positives which should be taken into consideration:
-He was in the military for 5 years in Mexico
-He has served in the Police force in Mexico for the greater portion of the last year
-I am bilingual in English & Spanish
-We are both capable and hard workers
-I have worked in the banking/mortgage business for years
-He has experience as a cook for years, in the army, and out
-We are both 100% dedicated to starting anew, and will do whatever it takes to find somewhere which will allow us to do just that, together.

The largest positive, however, is our (cheesiness warning) love for eachother. We want to raise a family. I have been told by lawyers to move to Mexico, if we really want to be together. Crimes of this nature occur all the time. Not to mention the drug conflict is verging on a full blown war in Mexico right now. As a police officer, and part of the military, my fiancé knows only too well the realities of a nation at war with its own corruption. And we both know, it is not where we want to start our family.
Any help would be incredibly appreciated. We very much wish to move to Canada, as my family lives in Oregon, US, it would be a 5-6 hour drive for them to visit us. But if Canada will not have us, we are looking into France, Spain, and Italy. We’re just two people, who, like most people, have pasts. But, I love him. And am only asking for the chance, to try. Is Frauding people a Sin?

My husbands in a lot of trouble and because of it I am too. He filed a bankruptcy here in California and signed my name to it.

The cops showed up with a marshell and took a lot of stuff away. Then they locked me out of my own shop so I cant make a living now.

A year ago he was out of a job. His benefits run out. Him and his brother decied to start a lawn business. They used a lot of credit cards from home depot, lowes, tractor co, master card and visa and an ameirican express card.

Adds up to about 65 thousan dollars. His borther lives in Oregon and they bought a trailer using another card an then hauled it all off to his brothers house.

They were suppose to be partners but I never seen a dime out of it. Well this weekend I found out what happen. His brothers keeping the money till hes out of bankruptcy.

I seen the papers he filed and he lied about everything he could to hide stuff. Hes got a big gun collection and its all registered and they took it away. It wasnt in the papers he filed. He bought some jewlry 2 months ago on a credit ccard and they took that away too.

The only thig he didnt lie about was my shop. He made suer to put it in there.

I called hsi ex-sister in law all frantic since theyre close. She admitted to an affair with him an its been going on for a year.

Wonderful husband of mine is a devout Christian. Hes been this way for 2 years cuz he says its right. He calls from jail tellin me to have faith in him and itll be alright an Godll bless us soon.

Is frauding people a sin? I want to throw his crap right back into his lying face! Give me some lines r something.

I cant wait to get my lawyer to sue for divorce. That husband of mine is a lying scum.
I talked to my lawyer today an call my parents. Im moving back to be with them and givin up the house and the shop. Everything. Anything to get away from that lier.
